Notice of Receipt of Income From Mortgaged Property

In the matter of section 104DD of the Property Law Act 1952, and in the matter of memorandum of mortgage number B. 093611.2 (South Auckland Registry) from Benda Investments Limited (mortgagor) to Stace Hammond Clients Securities Limited (mortgagee) over the land described in certificates of title 45C/37, 45C/39 and 45C/40 (South Auckland Registry):

Notice is given that:

1. On the 17th day of November 1994, Stace Hammond Clients Securities Limited, the mortgagee under the mortgage number B. 093611.2 (South Auckland Registry), entered into possession of the mortgaged property by receiving income from the mortgaged property.

2. The address of the mortgagee is care of Stace Hammond Grace and Partners, Stace Hammond House, 3 Caro Street, P.O. Box 19-101, Hamilton.

3. The description of the mortgaged property is:

   (a) A stratum estate in freehold within the meaning of the Unit Titles Act 1972 in Principal Unit D at Killarney Lane, 87 Killarney Road, Hamilton on Unit Plan number S. 53219, and Accessory Units AUD1, AUD2 and AUD3, and being all the land contained in certificate of title 45C/37.

   (b) A stratum estate in freehold within the meaning of the Unit Titles Act 1972 in Principal Unit F at Killarney Lane, 87 Killarney Road, Hamilton on Unit Plan number S. 53219, and Accessory Units AUF1, AUF2 and AUF3, and being all the land contained in certificate of title 45C/39.

   (c) A stratum estate in freehold within the meaning of the Unit Titles Act 1972 in Principal Unit G at Killarney Lane, 87 Killarney Road, Hamilton on Unit Plan number S. 53219, and Accessory Units AUG1, AUG2 and AUG3, and being all the land contained in certificate of title 45C/40.
