Additional Rights and Conditions Included in the Easement

  1. The grantee shall restrict the use of the right of way to the provision of access for undertaking soil conservation and river control purposes, including shingle extraction from the Tutaekuri River.

  2. The use of the right of way shall be restricted to the councils officers, workmen, agents or contractors of the grantee.

  3. The grantee shall maintain or reconstruct the private way as is necessary.

  4. The grantee is to take all reasonable steps necessary to minimise the dust and noise nuisance.

  5. The grantee shall be responsible for all maintenance costs with respect to the right of way.

  6. Except as modified herein the rights and powers set out in the Seventh Schedule of the Land Transfer Act 1952, shall apply.

Land Acquired for the Use in Connection With the Napier-Hastings Motorway—Hawke’s Bay District

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares an agreement to that effect having been entered into, the land described in the Schedule is acquired for the use in connection with the Napier-Hastings Motorway and shall vest in the Crown on the date of publication in the New Zealand Gazette.

1918 square metres, being Lot 26, Deposited Plan 24242, Block VIII, Heretaunga Survey District.

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares an agreement to that effect having been entered into, the land described in the Schedule is acquired for soil conservation and river control purposes and shall vest in The Hawke’s Bay Regional Council on the date of publication in the New Zealand Gazette.

Land Set Apart for Exchange Purposes—Hawke’s Bay District

Pursuant to section 52 of the Public Works Act 1981, and to a delegation from the Minister of Lands, and at the request of The Hawke’s Bay Regional Council, the District Solicitor, Department of Survey and Land Information, Napier, declares the land described in the Schedule held for soil conservation and river control purposes be set apart for the purposes of exchange, pursuant to section 105 of the Public Works Act 1981.

1.7029 hectares, being part Sections 18, 1, 2, 3, 4, 5, 48, 49 and 53 of Lot 2, Subdivision E, Heretaunga Block, being all of the land comprised in Proclamation 1655.

Road Realignment (Denlair Road) in the District of Wanganui

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Manager, Land and Property, Department of Survey and Land Information, Wellington:

(a) Pursuant to section 114 (1), declares the land described in the First Schedule to this notice to be road and vested in The Wanganui District Council on the date of publication hereof in the New Zealand Gazette.

(b) Pursuant to sections 116 (1), 117 and 120 (3), declares the portion of road described in the Second Schedule to this notice to be stopped and shall be amalgamated with the land in certificate of title, No. 18C/913, subject to memoranda of mortgage 102376.4 and B. 054247.2.
