Charitable Trusts Act Notices

Notice of Approval of a Scheme

Pursuant to Part III of the Charitable Trusts Act 1957

Notice is hereby given that approval of a scheme, as modified, in respect of the single trust fund which comprises bequests from the estates of the persons named below was given by order of the High Court at Palmerston North on Wednesday, the 10th day of March 1993.

The bequests were made by the persons named, and on the terms set out below:

Thomas Bates: “In trust to pay the residue of my estate and trust funds including accrued income to the Dannevirke Hospital and Charitable Aid Board towards the erection and upkeep of a childrens ward in the Dannevirke Hospital.”

Sophia Bates: “In trust to pay the residue of my estate including accrued income thereon to the Dannevirke Hospital and Charitable Aid Board to be devoted by the said board towards the erection and upkeep of a childrens ward in the Dannevirke Hospital.”

Winifred Eliza May: “In the exercise of a discretion vested in the trustees under the will of Winifred Eliza May the Dannevirke Hospital Board received 2 bequests to be applied to provide extra facilities and equipment not otherwise obtainable through the Health Department for the Multi-Handicapped Childrens Special Unit at Dannevirke.”

Ellen Hart: “That the residue be divided into five (5) equal parts and that 1 such part be held upon trust for the Dannevirke Hospital Board for use in the ward for multi-handicapped children.”

The scheme submitted to the Court was approved, as modified, as follows:

“The combined single trust fund derived from bequests received from the aforesaid estates be disposed of as follows:

(a) In payment of legal costs and disbursements, such sum or sums as the High Court may order.

(b) That after payment of costs and disbursements the balance of the fund (income and/or capital) be applied by the Manawatu-Wanganui Area Health Board in order or priority:

(i) First, for the erection, upkeep and running costs of the childrens facilities in the Dannevirke Hospital, including multi-handicapped children;

(ii) Secondly, for community based health services for children in the Tararua Health District, including multi-handicapped children.”

Declaration of the Assistant Registrar Revoking Dissolution of Societies

I, Lynette Shaw, Assistant Registrar of Incorporated Societies, hereby declare that it has been made to appear to me that the declaration dissolving the under-mentioned societies ought to be revoked, the said declaration is hereby revoked accordingly, pursuant to section 23 (3) of the Incorporated Societies Act 1908:
