Pursuant to section 9 of the Oaths and Declarations Act 1957, I hereby authorise the holders for the time being of the offices in the service of the Crown specified in the Schedule below to take statutory declarations under the said Act.

Defining the Limits of Maketu Estuary and Little Waihi Estuary, Kaituna River and the Waioteke and Otara Rivers Harbours—Bay of Plenty Regional Council

ORDER IN COUNCIL

At Wellington this 13th day of April 1993

Present:

THE RIGHT HON. DON McKINNON PRESIDING IN COUNCIL

Pursuant to section 3 of the Harbours Act 1950, Her Excellency the Governor-General, acting by and with the advice of the Executive Council, hereby defines the limits of Maketu Estuary and Little Waihi Estuary, Kaituna River and the Waioteke and Otara Rivers Harbours as described in the Schedule hereto.

Schedule

Maketu Estuary and Little Waihi Estuary and sea—All those tidal waters enclosed by the arc of a circle of 3 nautical miles radius centred on the northernmost point of Okurei Point at position 37° 44.55' S 176° 28.07' E excluding all the waters of the rivers and drains entering those estuaries.

Kaituna River—All the waters from the footbridge across the river between State Highway 33 and Okere Road to the inner limit of the territorial sea across the mouth of the Kaituna River.

Waioteke River and the Otara River—All those tidal waters enclosed by the arc of a circle of 0.5 mile radius centred on a point 37° 59.5' S 177° 16.3' E; the inner limits being the downstream sides of the State Highway 2 and State Highway 35 bridges.

Defining the Limits of Fighting Bay Harbour

THE RIGHT HON. DON McKINNON PRESIDING IN COUNCIL

Pursuant to section 3 of the Harbours Act 1950, Her Excellency the Governor-General, acting by and with the advice of the Executive Council, hereby defines the limits of Fighting Bay Harbour as described in the Schedule hereto.

Schedule

Fighting Bay Harbour—Being all that area of the sea and tidal waters enclosed by a straight line commencing at the waters edge at position 41° 18.51' S 174° 14.28' E, then by a straight line to position 41° 18.3' S 174° 16.2' E, then by a straight line to position 41° 22.05' S 174° 14.6' E, then by a straight line to the waters edge at position 41° 20.3' S 174° 10.6' E, then by the line to waters edge at the point of commencement.
