Land Acquired and Right of Way Easement Acquired—Mata Road, Gisborne District

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Survey and Land Information, Gisborne, declares that, an agreement to that effect having been entered into:

(1) The land described in the First Schedule is acquired for the purposes of a radio transmitter site and shall vest in The Poverty Bay Electric Power Board on the date of publication in the Gazette.

(2) The easement described in the Third Schedule is acquired as an easement in gross for the purposes of a radio transmitter site over those parts of the land in the Second Schedule described in the Third Schedule and shall vest in The Poverty Bay Electric Power Board (called the grantee) on the date of publication in the Gazette and may be surrendered by notice published in the Gazette.

Being Part Section 4, Block IV, Tutamoe Survey District; marked “A” on S.O. 8600.

Second Schedule

Area
2023.5632 ha

Being Part Section 4, Block IV, Tutamoe S.D. (certificate of title 4C/962).

Third Schedule

A right of way over the piece of land described as part Section IV, Tutamoe S.D.; marked “B” on S.O. 8600, which is held in the office of the Chief Surveyor at Gisborne.

Additional Rights and Conditions Included in the Easement

  1. The grantee shall not be required or empowered to fence the boundaries of the right of way.

  2. Neither the grantor nor the grantee shall be required to maintain the right of way but either may, at their own expense, maintain or improve the right of way to a standard sufficient for their own purposes.

  3. Except as varied herein the rights and power contained in the Seventh Schedule of the Land Transfer Act 1954, shall apply.

Transit New Zealand Act 1989

Revoking Section of State Highway and Declaring New Sections of State Highway

Pursuant to section 60 of the Transit New Zealand Act 1989, the Transit New Zealand Authority gives notice that, with effect from midnight on 21 March 1993, the section of State highway described in the First Schedule hereto is revoked, and the sections of highway described in the Second Schedule hereto are declared to be State highway within the meaning and for the purpose of the Transit New Zealand Act 1989.

First Schedule

At Waipu all that part of No. 1 State Highway from its junction with Rosyth Road at Route Position 188/12.51 through Connell Road, Ureti Road, Cove Road, South Road, St Mary’s Road and Shoemaker Road to its junction with Millbrook Road at existing Route Position 203/1.72.

Second Schedule

At Waipu No. 1 State Highway to include the section of new public highway known as the Waipu Bypass from Rosyth Road at Route Position 188/12.51 through its junction with Shoemaker Road to its junction with Millbrook Road at existing Route Position 203/1.72.

At Mangonui No. 10 State Highway to include the section of new public highway known as the Mangonui Bypass from Route Position 63/10.95 through its junction with Colonel Mould Drive to its junction with the old State Highway No. 10 at new Route Position 63/12.00.

Declaring State Highway to be a Limited Access Road State Highway No. 1: Waipu

It is noted that Transit New Zealand, by resolution dated 3 March 1993 and pursuant to section 88 (1) of the Transit New Zealand Act 1989, hereby declares that part of State Highway No. 1 at Waipu to include the section of new public highway known as the Waipu Bypass from Rosyth Road at Route Position 188/12.51 through its junction with Shoemaker Road to its junction with Millbrook Road at existing Route Position 203/1.72 as more particularly shown on Sheet 1 of Plan 1/16/1/311/5/1 and accompanying Schedule held in the
