Advertisement of Application for Varying the Mode of Administration of Trust by the Court

In the High Court of New Zealand, Wellington Registry

Under the Charitable Trusts Act 1957, and under the Trustee Act 1956, in the matter of The Todd Foundation, a trust for charitable purposes, between the Todd Foundation Administration Board, a board incorporated and registered under the Charitable Trusts Act 1957—First Plaintiff;

And—the Todd Foundation Investment Board, a board incorporated and registered under the Charitable Trusts Act 1957—Second Plaintiff;

And—The Attorney-General for New Zealand—Defendant:

Take notice that on the 20th day of January 1993, an application for orders, pursuant to section 33 of the Charitable Trusts Act 1956 and pursuant to section 66 of the Trustee Act 1956, was filed in the High Court at Wellington.

The application seeks orders varying the mode of administration of The Todd Foundation, with respect to the appointment of members of the Todd Foundation Administration Board and with respect to the affixing of the common seal of the Todd Foundation Administration Board and the Todd Foundation Investment Board.

The application is to be heard before the High Court at Wellington on the 24th day of March 1993 at 10 a.m.

Any person wishing to oppose the application must give written notice of his/her intention to do so to the Registrar of the High Court at Wellington, the trustees of the Todd Foundation and the Attorney-General not less than 7 clear days prior to the date proposed for the hearing of the application by the Court.

Further particulars of the application may be obtained from the statement of facts, submissions and scheme, a copy of which may be obtained from the office of the High Court at Wellington or from the solicitors for the plaintiffs, Messrs Kensington Swan, Solicitors, Second Floor, Fletcher Challenge House, 87–91 The Terrace (P.O. Box 10 246), Wellington.
