Bequests From the Estates of Thomas Bates, Sophia Bates, Winifred Eliza May and Ellen Hart

Pursuant to Section 36 of the Charitable Trusts Act 1957

Take notice that on Wednesday, the 10th day of March 1993 at 9.30 a.m., the Manawatu-Wanganui Area Health Board, the trustee of the single trust fund which comprises bequests from the estates of the above-named persons (“the fund”), will apply to the High Court at Palmerston North for approval of a scheme for the disposition of the property and/or income comprised in the fund.

The bequests were made on the following terms:

Thomas Bates—“In trust to pay the residue of my estate and trust funds including accrued income to the Dannevirke Hospital and Charitable Aid Board towards the erection and upkeep of a childrens ward in the Dannevirke Hospital.”

Sophia Bates—“In trust to pay the residue of my estate including accrued income thereon to the Dannevirke Hospital and Charitable Aid Board to be devoted by the said board towards the erection and upkeep of a childrens ward in the Dannevirke Hospital.”

Winifred Eliza May—“In the exercise of a discretion vested in the trustees under the will of Winifred Eliza May the Dannevirke Hospital Board received two bequests to be applied to provide extra facilities and equipment not otherwise obtainable through the Health Department for the multi-handicapped childrens special unit at Dannevirke.

Ellen Hart—“That the residue be divided into five (5) equal parts and that 1 such part be held upon trust for the Dannevirke Hospital Board for use in the ward for multi-handicapped children.”

Orders will be sought that the terms of the bequests of Thomas Bates, Sophia Bates and Ellen Hart be varied, and the bequest of Winifred Eliza May be deemed to be correctly applied if applied, to provide for the disposition of the fund:

“(a) In payment of legal costs and disbursements, such sum or sums as the High Court may order.

(b) That after payment of costs and disbursements the balance of the fund (income and/or capital) be applied by the Manawatu-Wanganui Area Health Board:

(i) Firstly, for the erection, upkeep and running costs of the childrens facilities in the Dannevirke Hospital;

(ii) Secondly, for community based health services for children in the Tararua Health District; and

(iii) Thirdly, generally towards the erection, upkeep and running costs of the facilities of the Dannevirke Hospital.”

Any person desiring to oppose this scheme is required to give written notice of objection to the Registrar of the High Court at Palmerston North, to the trustee and to the Attorney-General not less than 7 clear days before the hearing date set out above.

Potter Masonic Trusts

Notice of Application for Approval of a Scheme for Variation

Pursuant to Part III of the Charitable Trusts Act 1957

Notice is hereby given that the trustees of the Grand Lodge of Antient Free and Accepted Masons of New Zealand as trustees of the Potter Masonic Trusts have filed in the office of the High Court at Auckland, an application for approval of a scheme for the further variation of the charitable trusts created by Frederick Seymour Potter under which certain property (including the Potter Masonic Centre at Papakura) is held.

The trusts in their present form make particular provision for the retention and use of the centre as a childrens home, and provide for the support of that home and for other charitable purposes in the Provincial District of Auckland. The scheme in its present form contains some ambiguities. The trustees also consider that changed circumstances justify variation of provisions including those relating to the management of the trust, the operation of the centre and the investment powers of trustees.

Under the variations now proposed:

(a) The amended charitable purposes will in essence be preserved subject to amendments of description;

(b) The prohibition on the sale of the Potter Masonic Centre and a Rutland Street, Auckland, property will be preserved;

(c) The distinction between the income and capital endowment funds will not be maintained;

(d) Investment in terms of the Trustees Act 1956, will be permitted;

(e) The management provisions will be clarified;

(f) Provision for preference for the children of freemasons will be deleted;

(g) Some other, now seen to be inappropriate, restrictions will be deleted.

Copies of the scheme and the report of the Attorney-General thereon may be inspected, free of charge, at the office of the Registrar of the High Court at Auckland, or at the offices of trustees which for the purposes of this application are the offices of Holdmen Horrocks, Solicitors, Level Four, DFC House, 350 Queen Street, Auckland.

The application has been set down for hearing in the High Court at Auckland on Friday, the 26th day of February 1993 at 10.30 a.m.

Any person desiring to oppose the scheme is required to give notice of his or her intention to do so to the Registrar of the High Court at Auckland and to the trustees and the Attorney-General not fewer than seven (7) clear days before the above-mentioned date.
