Notice Pursuant to Section 75 of the Trustee Act 1956

In the matter of the Trustee Act 1956, and in the matter of Alexander Associates Limited; Alexander Acceptances Limited; Restpoint Roadhouses Limited; Restpoint Park Limited; Alexander Nominees Limited; Ko Val Limited; Savings and Second Mortgage Limited; Advisorcorp Group Limited; Advisorcorp Securities Limited; Advisorcorp Nominees Limited; Tait Associates Limited; Advisorcorp Consultants Limited; Advisorcorp Brokers Limited; and Alexander Agora Limited (all in statutory management—“the Advisorcorp Group of Companies”):

To: All persons who invested monies with the Advisorcorp Group of Companies for the purpose of investment by way of contributory mortgage or for any specific trust.

Pursuant to section 75 of the Trustees Act 1956 (“the Act”) the statutory managers of the Advisorcorp Group of Companies as trustees hereby call upon you within a period of 3 months from the date of service of this notice, to enforce any claim which you may have to trace your monies into a specific investment and to prosecute those proceedings with all due diligence.

At the expiration of the said 3 month period the statutory managers as trustees will apply to the Court for the orders pursuant to section 75 (3) of the Act. If such an application is made in relation to your claim, we shall serve a copy of the application on you. If on the hearing of that application you do not satisfy the Court that you have commenced proceedings and are prosecuting them with all due diligence the Court may take orders:

(a) Extending the period for, or barring, your claim or enabling the trust property to be dealt with without regard to the claim; and

(b) Imposing such conditions and giving such directions, and including a direction as to the payment of the costs of or incidental to the application, as to the Court seems just.

The statutory managers have served similar notices upon all mortgage investors, and all others known to the statutory managers who have indicated that their funds have been employed in breach of trust.

When the period specified in each of the notices has expired, the statutory managers will apply for an order in respect of the claims of those investors in a single application and the Court may on that application make orders accordingly.
