Whereas The New Zealand Guardian Trust Company Limited has not established a garden settlement as was desired by the testator under the above-mentioned deed of trust.

And whereas it is inexpedient for the trustee to establish such a garden settlement with the amount of money available being inadequate to carry out that purpose.

And whereas there has been incorporated a charitable trust known as the Bethsaida Home Trust whose objects inter alia are to administer villas for occupation and ownership by the elderly.

And whereas the said Bethsaida Home Trust has acquired further property in Blenheim to enable it to continue to provide accommodation for the elderly.

And whereas the trustee desires that the trust assets shall be dealt with pursuant to the provisions of Part III of the said Act.

Now therefore the trustee has prepared a scheme for the disposition of the trust assets and the said scheme is as follows:

1. The trustee being satisfied that the property situated at Blenheim but more particularly described as 1.1914 hectares being Lot I on Deposited Plan 4754 and being all the land in certificate of title Volume 3A, folio 799 (Marlborough Registry), has been transferred to the Bethsaida Home Trust. The trustee shall transfer, assign and deliver to the Bethsaida Home Trust completely and free from any of the trusts contained in the said Deed of Trust all property of any kind then belonging to or held by the Trustee under the said Deed of Trust, including all funds.

2. The reasonable costs of and incidental to, preparing and advertising this scheme and of having the same approved by the Court, including the costs of the Attorney General, shall be paid out of the trust assets.

Hearing of Application:

The hearing of the application by the Court has been set down for Monday, the 20th day of July 1992 at 10 a.m. at the Courthouse, Blenheim.

Opposition to Scheme:

Any person desiring to oppose the scheme shall, not less than 7 clear days before the date proposed for the hearing of the application by the Court, give written notice of his/her intention to oppose the scheme to the Registrar, High Court, Blenheim and to the New Zealand Guardian Trust, P.O. Box 541, Nelson and to the Attorney-General, care of Crown Law Office, P.O. Box 5012, Wellington.
