The New Zealand Guardian Trust Co Limited Trustees Notice of Application

Pursuant to Part 3 of the Charitable Trusts Act 1957

The New Zealand Guardian Trust Co Limited trustees for the John Alexander McDonald Trust will apply to the High Court at Whangarei on the 22nd day of July 1992 at 9.15 a.m., for approval of a scheme varying and extending the powers of trustees and varying the modes of administering the trust by amending the existing trust deed dated the 29th day of September 1945.

Any person who wishes to oppose the scheme is required to give notice of such intention to the Registrar of the Court and the applicant and the Attorney General by not later than the 14th day of July 1992.

The address for service of the applicant is at the offices of Messrs Connell Rishworth Gerard, corner of Vinery Lane and Bank Street (P.O. Box 242), Whangarei.

The scheme may be examined free of charge at the office of the Court or the office of the applicant’s solicitors.

Notice of Dissolution of a Partnership

Take notice that Richard James Barry, Graham Charles Hare, William Beau Holland, Allen Conway Hunter, John Douglas Patterson and Michael John Smith, practising together as Holland Beckett Maltby, solicitors of Tauranga, hereby give notice, pursuant to section 39 of the Partnership Act 1908, that Peter Philip Butler and Gerald Michael Fitzgerald ceased to be partners of the firm as from the 31st day of December 1988.

The amount of capital contributed by E. B. S. Grey, being $5,000.00 and J. D. Grey $5,000.00; and J. A. Mudie, A. H. Bell, G. P. Hessey, S. W. Mennell and G. A. Keen being $1,000.00 each to the common stock.

The business to be transacted is that of owners of thoroughbred bloodstock and the principal place at which business is to be transacted is at Timaru and the partnership commenced on the date of filing of this certificate of special partnership and is to terminate 7 years after the date of filing of the said certificate.

In the matter of Part II of the Partnership Act 1908, and in the matter of Tuhikaramea (1992) Limited and Company:

It is hereby certified, pursuant to section 51 of the Partnership Act 1908, that:

  1. The name of the special partnership is Tuhikaramea Limited and Company (1992).

  2. The names and addresses, occupations and capital contributions of the general and special partners are as set forth in the Schedule.

  3. The objects of the partnership shall be:
    (a) To establish and carry on in New Zealand and elsewhere, business as racers of thoroughbred horses as a recreational pursuit (hereinafter called the “partnership business”).

  4. The principal place from which the partnership business will be conducted at Hamilton and Sydney.

  5. The partnership shall commence upon registration of the certificate, pursuant to section 54 of the Partnership Act 1908, and subject to the provisions in the deed of partnership relating to earlier dissolution shall terminate upon the expiry of 4.5 years from the date of registration of this certificate.
