Amending a Notice Acquiring Land for Road, Declaring Land to be Road, Road Stopped and Land Taken in the District of Rangitikei
Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Survey and Land Information, Wellington hereby amends the notice dated 14 September 1990, acquiring land for road, declaring land to be road, stopped and land taken, published in the New Zealand Gazette of 4 October 1990, No. 173 at page 3740 by deleting paragraph (c) (ii) and substituting it with the following:
“(c) (ii) The area described in the Fourth Schedule shall be amalgamated with the land in certificate of title No. 34D/698, subject to memoranda of mortgage 664668.2 and 529994.5.”

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Christchurch, declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto, is hereby acquired for education purposes and shall vest in the Crown on the date of publication of this declaration in the Gazette.

A Power Supply Easement in Gross Acquired in Kaiapoi
Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Christchurch, declares that, an agreement to that effect between the Crown and the North Canterbury Electric Power Board having been entered into, the power supply easement in gross described in the First Schedule is hereby acquired over the land in the Second Schedule and the said easement shall vest in perpetuity in the North Canterbury Electric Power Board for power supply purposes on the date of publication of this notice in the Gazette.
First Schedule
Canterbury Land District—Waimakariri District

The full free, uninterrupted and unrestricted right liberty and privilege for the North Canterbury Electric Power Board (hereinafter called “the Board”) and its agents and successors from time to time and all times hereafter to convey and transmit electric power and energy through under and along that part of the land described below marked A on Deposited Plan Number 59719 (hereinafter called “the easement site”) by means of an underground cable or cables now or hereafter to be laid and any cable or cables laid in substitution therefor and erect maintain replace and inspect an electrical substation and switchgear together with all necessary machinery equipment and fittings on that part of the land described marked A on Deposited Plan 59719.

The Board by means of its servants agents contractors and workmen may enter upon the above described land at any time by night as well as by day with or without vehicles plant equipment and implements for the purposes of inspection maintenance installation repair and/or replacement of the said underground cable or cables or any associated equipment or fittings of the Board so that the same may at all times be kept in good and efficient working order.

The Board may dig up and excavate the easement site for all or any of the said purposes and if necessary may deposit soil upon the Crown’s land adjoining the same provided always that all work shall be carried out expeditiously and on completion the surface of any land affected will forthwith be restored as nearly as possible to its former state and condition to the satisfaction of the Crown at the sole cost and expense of the Board.

In exercise of the rights hereby granted the Board will not unduly interfere with any other lawful user of the Crown’s land and will except in case of emergency give reasonable notice to the Crown of the Board’s intention to carry out any works authorised hereby.

The Crown will not do nor suffer nor permit to be done any act matter or thing whereby the Board’s rights hereunder or any of the said cables equipment or fittings may be interfered with or affected and in particular (but not so as to restrict the generality of this Clause) the Crown will not place or plant nor suffer nor permit to be placed or planted on the easement site any tree or shrub.

In case of any difference or dispute as to any clause matter or thing herein contained or implied or as to the construction thereof or in respect of the rights or liabilities of the parties hereunder the same shall be decided by a single arbitrator should the parties agree otherwise by the arbitration of two independent persons one to be appointed by each party.

The terms and conditions set forth shall be binding on the successors and assigns of the Board and the Crown.
