Notice of Dissolution of Partnership

Notice is hereby given that the partnership of Marie Bernadette Mullins and Rosemary Elizabeth Wall (previously trading under the partnership name Parnell Physiotherapy Clinic) from premises at 72A Gladstone Road, Parnell, Auckland, has been dissolved, effective from the 31st day of August 1991. Marie Bernadette Mullins retired from the partnership as at that date.

Notice of Proposed Release of Deposit

Pursuant to Insurance Companies Deposits Act 1953

Capital Life Assurance Limited (herein called “the company”) has given notice to the Public Trustee that it has ceased to carry on the business of insurance in New Zealand and that it proposes to withdraw, pursuant to section 19 of the Insurance Companies Deposits Act 1953 (herein called “the Act”) the deposit which has been made by it with the Public Trustee.

The Public Trustee therefore gives notice, pursuant to section 9 of Act, that being satisfied that all liabilities of the company in New Zealand in respect of such insurance business have been fully liquidated or provided for he proposes to release to the company, on or after the 1st day of August 1992, the amount deposited with him by the company.

Any objections to the release of the amount deposited should be lodged with the District Public Trustee at the Public Trust Office, 117–129 Lambton Quay, Wellington 1, on or before the 1st day of July 1992.

Take notice that on Thursday, the 30th day of April 1992 at 10 a.m., or as soon thereafter as counsel can be heard, the plaintiffs will apply to the Court at Wellington for orders:

1. Barring any person upon whom notice has been served, pursuant to section 75 of the Trustee Act 1956, from taking legal proceedings to enforce any claim which he might have against the plaintiffs.

2. Empowering the plaintiffs to deal with and make a partial distribution of the trust property held by them without regard to any such claim.

This application is made upon the ground that a period of 3 months has expired since the date upon which notices, pursuant to section 75 (1) of the Trustee Act 1946, were served upon persons having potential claims against the plaintiffs in their capacities as the statutory receivers and managers of the above-named defendant companies.

This application is made in reliance on section 75 of the Trustee Act 1956.
