Summary of Bills Introduced

Citizens Initiated Referenda

This Bill, which is to come into force on 1 July 1992, provides for the holding of citizens’ initiated referenda. Such referenda must relate to specific questions. The results of such referenda will be indicative of the views of the people but will not be binding on the Government. The Bill requires the Government to hold a referendum on an issue if a petition proposing a referendum has obtained the support of ten percent of the people on the electoral roll.

Local Legislation

This Bill confers powers on certain public bodies and authorises and validates certain transactions and other matters. Namely, it validates rates made for the 1988–89 year by the former Lawrence Borough Council that exceeded limits imposed by the Local Government Act 1974; it validates the purchase by the Palmerston North City Council of a gymnasium then situated on a public park; and repeals a number of spent Local Acts, and spent provisions of Local Legislation Acts.

Dumping and Countervailing Duties Act 1988

Preliminary Determination: Carbon-Zinc Primary Cell Batteries From Korea

Pursuant to section 12 (1) of the Dumping and Countervailing Duties Act 1988, I, Philip Burdon, Minister of Commerce, hereby give notice that I have made a preliminary determination on the basis of the information made available during the investigation, that there is reasonable cause to believe that carbon-zinc primary cell batteries of sizes AA, C and D, sourced from Korea, and imported or intended to be imported into New Zealand, are goods in respect of which I may direct the imposition of an anti-dumping duty in accordance with section 14 of the Dumping and Countervailing Duties Act 1988.

Explanatory Note

This note is not part of the notice, but is intended to indicate its general effect.

The effect of this notice is to continue for up to a further 90 days the investigation into the dumping of carbon-zinc primary cell batteries from Korea, so that a final determination can be made. No provisional duties have been imposed for the remaining period of the investigation.

Determination as Specified Importers

Notice is hereby given that I, Alexander Hugh McPhail, Manager, Trade Remedies Group, Ministry of Commerce, acting pursuant to section 3A (2) of the Dumping and Countervailing Duties Act 1988, and under delegated authority from the Secretary of Commerce, have determined that Lydiard Shoe Co Limited and Skellerup Footwear Limited, New Zealand producers of certain mens footwear who are also importers of like goods are “specified importers”.

The brief reasons for this determination being made are that having regard to the nature and extent of the importations of the allegedly dumped goods including the value, quantity, frequency and purpose of the importations, I am satisfied that Lydiard Shoe Co Limited and Skellerup Footwear Limited should not be excluded from being treated as New Zealand producers for the purposes of the Dumping and Countervailing Duties Act 1988.

Initiation of Dumping Investigation: Certain Men’s Footwear From China, Hong Kong, Indonesia, Korea, Taiwan and Thailand

Notice is hereby given that I, Alexander Hugh McPhail, Manager, Trade Remedies Group, Ministry of Commerce, acting pursuant to section 10 (1) of the Dumping and Countervailing Duties Act 1988, and under delegated authority from the Secretary of Commerce, have initiated an investigation to determine both the existence and effect of alleged dumping of the goods listed in the Schedule to this notice, being satisfied that sufficient evidence has been provided that:

(a) The goods imported or intended to be imported into New Zealand are being dumped; and

(b) By reason thereof material injury to an industry has been or is being caused, or is threatened.

Schedule

Country of Origin: China, Hong Kong, Indonesia, Korea, Taiwan and Thailand.

Description of Goods Subject to Investigation: Men’s shoes, including sports casual shoes but EXCLUDING the following categories:

  • Men’s and boys’ shoes size 4 and below.
  • Sports footwear:
    (a) footwear which is designed for a sporting activity and has, or has provision for the attachment of spikes, sprigs, stops, clips, bars or the like;
    (b) skating boots, ski boots and cross-country ski footwear, wrestling boots, boxing boots and cycling shoes.
  • Slippers.
  • Footwear with upper straps or thongs assembled to the sole by means of plugs.
  • Footwear incorporating a protective metal toe cap.
