Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier:

(a) Pursuant to section 114 (1), declares the land described in the First Schedule hereto, to be road and vested in The Napier City Council which, pursuant to section 60 (2) of the Transit New Zealand Act 1981, forms part of State Highway 2.

(b) Pursuant to section 114 (1), declares the land described in the Second Schedule to be accessway vested in The Napier City Council.

(c) Pursuant to sections 116 (1), declares the road described in the Third Schedule to be stopped.

Pursuant to section 20 (1) of the Public Works Act 1981 and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares that an agreement, that effect having been entered into, the easement described in the Second Schedule hereto is acquired as an easement in gross over those parts of the land described in the First Schedule as are specified in the Second Schedule and shall vest in The Wairoa District Council for sewage disposal purposes on the date of publication in the Gazette. Such easement may be surrendered at any time by notice published in the Gazette.
