Land and Right of Way Easement Over Land in Rotorua District Set Apart for Fish and Game Management Purposes

Pursuant to section 52 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor of the Department of Survey and Land Information, Hamilton, declares the land described in the First Schedule hereto and the right of way easement over land described in the Second Schedule hereto, to be set apart for fish and game management purposes and vested in The Eastern Region Fish and Game Council.

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor of the Department of Survey and Land Information, Hamilton, declares that, agreements to that effect having been entered into, the land described in the Schedule hereto, is hereby acquired for road and shall vest in the Crown on the date of publication hereof in the Gazette.

Land at Methven Acquired for Recreation Reserve

Pursuant to sections 20 (1) and 50 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Christchurch, declares that an agreement to that effect having been entered into, the piece of land described in the First Schedule hereto, is hereby acquired for a recreation reserve and shall vest in The Ashburton District Council on the date of publication of this declaration in the Gazette. The land is acquired subject to an easement in gross to convey telecommunications reserve in favour of Her Majesty the Queen for telecommunication purposes (called “the grantee”) upon the terms and conditions as set out in the Second Schedule.

All that piece of land containing 172 square metres, being part Section 2, S.O. Plan 17912; shown marked “C” on plan. Part Gazette notice 818421.

Second Schedule

Description of Easement to Convey Telecommunications by Earth Mat Cables in Gross

The full, free, uninterrupted and unrestricted right, liberty and privilege for the grantee, its servants, tenants, agents, workmen, licensees and invitees, from time to time and at all times to take, convey and lead telecommunications by earth mat cables in an unimpeded flow within the land described in the First Schedule, and shown marked “C” in Survey Office Plan 17912.

Conditions applying to the easement:

  1. That all works authorised to be carried out hereunder on the easement area shall be carried out as expeditiously as possible and with as little disturbance to the surface of the land as is reasonably possible and immediately upon completion of any such work the surface of the land shall be restored as nearly as is reasonably possible to its former condition.

  2. That the council will not place any buildings, erections or fences on the stipulated area and will not at any time hereafter do or permit or suffer any act whereby the rights hereby granted to the grantee may be interfered with or affected in any way.

  3. That nothing herein contained or implied shall impose any liability upon the council to contribute to the cost of any such works herebefore described except where such work has been caused by the actions or omissions of the council or the council’s tenants, servants, agents or workmen.

  4. That nothing herein contained shall be deemed to abrogate, limit, restrict or abridge any other rights, powers and remedies vested in the grantee by any statute and in particular...
