265 of the Harbours Act 1950 to the Secretary for Transport by an instrument of delegation, dated the 12th day of April 1990.

And whereas, pursuant to section 41 of the State Sector Act 1988, the Secretary for Transport did delegate those powers under section 265 of the Harbours Act 1950 to me by instrument of delegation, dated the 9th day of May 1990.

Therefore, I, Thomas Edwin Law, hereby, pursuant to section 265 of the Harbours Act 1950, validate the proceedings relating to the Bay of Plenty Regional Council Bylaw No. 1, that were implemented and approved by Council on the 1st day of October 1990 notwithstanding that the Minister of Transport’s acknowledgment required under section 234 of the Harbours Act 1950 would have been given and had effect from the 1st day of October 1990.

Declaration Under the Submarine Cables and Pipelines Protection Act 1966

Whereas, pursuant to section 28 of the State Sector Act 1988, the Minister of Transport did delegate his power under section 7 (4) of the Submarine Cables and Pipelines Protection Act 1966, to the Secretary for Transport by an instrument of delegation, dated the 12th day of April 1990.

And whereas, pursuant to section 41 of the State Sector Act 1988, the Secretary for Transport did delegate that power under section 7 (4) of the Submarine Cables and Pipelines Protection Act 1966 to me by an instrument of delegation, dated the 9th day of May 1990.

Therefore, I, Thomas Edwin Law, hereby make the following declaration:

Declaration

The Submarine Cables and Pipelines Protection Order 1979 shall not apply in respect of the ship or vessel:

whilst working in the protected area designated “Area 11—Oaonui” and whilst working in the restricted area designated “Area 12—Maui ‘A’ and Maui ‘B’ Pipelines” for the purpose of carrying out work on the pipeline structure and platform for Maui ‘A’ and Maui ‘B’ for the period on and from 15 February 1992 to 1 July 1992 or the completion of work, whichever occurs first.

Transport Act 1962

The Traffic (Papakura District) Notice No. 1 1992

Pursuant to the Transport Act 1962, a delegation from the Minister of Transport, and a subdelegation from the Secretary for Transport, I, Carne Maurice Clissold, Controller, Road and Traffic Standards, give the following notice:

This notice may be cited as the Traffic (Papakura District) Notice No. 1 1992.

The area and roads specified in the First Schedule are declared to be closely populated localities for the purposes of section 52 of the Transport Act 1962.

The roads specified in the Second Schedule are declared to be 70 kilometres an hour speed limit areas pursuant to regulation 21 (2) of the Traffic Regulations 1976.

The Traffic (Franklin County) Notice No. 1, 1989, signed on the 7th day of August 1989*, and the Traffic (Papakura City and Manukau City) Notice No. 1, 1987, signed on the 9th day of December 1987†, and the Traffic (Franklin County) Notice No. 2, 1987, signed on the 8th day of May 1987‡, issued pursuant to section 52 of the Transport Act 1962 and regulation 21 (2) of the Traffic Regulations 1976 are revoked.

First Schedule

Situated within Papakura District at Papakura, Takanini and Red Hill:

All that area with the exception of No. 1 State Highway (Awanui—Bluff) bounded by a line commencing at a point on the western side of Great South Road at its intersection with the southern bank of the Papakura Stream; thence southerly, generally, by a right line to the north-western terminating end of Adios Place; thence southerly, generally, by a right line to the southern terminating end of Elana Court; thence south-easterly, generally, by a right line to the north-eastern terminating end of Hilldane Road; thence due east by a right line to a point on the western side of No. 1 State Highway (Awanui—Bluff) 1,110 metres measured northerly, generally, along the said State Highway from the north-western abutment of the Beach Road overbridge; thence across the No. 1 State Highway (Awanui—Bluff) at right angles from its western side to its eastern side; thence southerly, generally, by a right line to the north-eastern abutment of the Beach Road overbridge; thence southerly, generally, by a line following the eastern road boundary of No. 1 State Highway (Awanui—Bluff) to the south-eastern abutment of the Park Estate Road overbridge; thence easterly, generally, by a right line to a point on the western side of Dominion Road; thence north-easterly, generally, by a right line to the southern abutment of the Red Hill Road overbridge; thence due east to the southern side of Red Hill Road; thence due east by a right line to the southern termination of Redmount Place; thence north-easterly, generally, by a right line to the southern side of Red Hill Road to a point 60 metres measured north-easterly, generally, along the said road from Gibbs Crescent; thence across Red Hill Road at right angles from its southern side to its northern side; thence north-westerly, generally, by a right line to the northern terminating end of Morgan Place; thence north-westerly, generally, by a right line to a point on the southern side of Settlement Road 100 metres measured easterly, generally, along the said road from its intersection with the eastern side of Hunuas Road; thence across Settlement Road at right angles from its southern side to its northern side; thence generally north-easterly by a right line to the intersection of the eastern side of Dominion Road with the southern side of Park Estate Road; thence northerly, generally, along the western side of Park Estate Road to its intersection with the southern side of Hunuas Road; thence across Hunuas Road at right angles from its southern side to its northern side; thence north-easterly, generally, along the eastern side of Hunuas Road to its intersection with the northern side of Crosby Road; thence north-easterly, generally, along the northern side of Crosby Road to its intersection with the western side of Dominion Road; thence northerly, generally, along the western side of Dominion Road to a point 300 metres measured southerly, generally, along the said road from Settlement Road; thence across Dominion Road at right angles from its western side to its eastern side; thence south-easterly, generally, along the eastern side of Dominion Road to its intersection with the southern side of Red Hill Road; thence due east by a right line to the southern termination of Redmount Place; thence north-easterly, generally, by a right line to the point of commencement.
