Ministers of Finance and Crown Research Institutes, the Director (Statutory), Department of Survey and Land Information, hereby gives notice as follows:

Notice

  1. Title—(1) This notice may be cited as the The Horticulture and Food Research Institute of New Zealand Vesting Notice 1992, No. 1.

  2. Application—(1) This notice applies to all the land described in the Schedule to this notice, saving and excepting:

    (a) The bed of any lake whose bed has an area of 8 hectares or more;

    (b) The bed of any river whose bed has an average width of 3 metres or more;

    (c) Any land covered and uncovered by the flow and ebb of the tide at mean spring tides.

    (2) In subclause (1) of this clause, the terms “bed”, “lake,” and “river” have the meanings assigned to them by section 2 (1) of the Resource Management Act 1992.

  3. Vesting—Subject to section 24 of the Conservation Act 1987, the land to which this notice applies:

    On the date of publication of this notice in the Gazette shall vest for an estate in fee simple in The Horticulture and Food Research Institute of New Zealand Limited (a company duly incorporated under the Companies Act 1955, having its registered office at Palmerston North, and being a Crown Research Institute within the meaning of section 23 (1) of the Crown Research Institutes Act 1992:

    (i) Together with the appurtenant rights (if any) described in the Schedule to this notice; but

    (ii) Subject to the rights, interests and incumbrances (if any) to which it is described in the Schedule to this notice as being subject.

Public Works Act 1981

Land Acquired for Soil Conservation and River Control Purposes in Western Bay of Plenty District

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Hamilton, declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for soil conservation and river control purposes and shall vest in The Bay of Plenty Regional Council on the date of publication hereof in the Gazette.

5310 hectares, being part Lot 2, D.P. S. 39737; as shown marked “4D” on S.O. Plan 57486, lodged in the office of the Chief Surveyor at Hamilton.

Road Realignment in Thames-Coromandel District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager of the Department of Survey and Land Information, Hamilton:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Thames-Coromandel District Council.

(b) Pursuant to section 116, declares the piece of road described in the Second Schedule hereto to be stopped.

(c) Pursuant to section 119, declares the land described in the Third Schedule hereto to be taken and vested in The Thames-Coromandel District Council.

1199 square metres, situated in Block VIII, Harataunga Survey District, being part Lot 2, D.P. S. 28883; as shown marked “I” on S.O. Plan 58283, lodged in the office of the Chief Surveyor at Hamilton.

Pursuant to section 20 (1) of the Public Works Act 1981, and to section 88 (2) of the Transit New Zealand Act 1989, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Wanganui, declares that, agreements to that effect having been entered into, the land described in the Schedule hereto, is hereby acquired for limited access road and has become road, limited access road and State highway and shall vest in the Crown on the date of publication hereof in the Gazette.
