Land and an Interest in Land Acquired for Sanitary Works (Sewage Treatment Site) in Far North District

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, declares that, an agreement to that effect having been entered into, the land firstly described in the First Schedule, and a right of way easement over the land secondly described in the First Schedule, containing the rights and powers set forth in the first paragraph of the Seventh Schedule of the Land Transfer Act 1952 and as modified by the Second Schedule herein, are acquired for sanitary works (sewage treatment site) and the said land and easement shall vest in The Far North District Council on the date of publication in the Gazette.

Second Schedule

North Auckland Land District

The Far North District Council (hereinafter called “the council”) shall maintain and repair the right of way at its own expense and any dispute as to the liability of the Council under this condition shall be determined by arbitration under the Arbitration Act 1908.

The council shall install and maintain in good repair at all times a good and substantial stock proof gate at the western end of the area marked “A” on S.O. Plan 64739, tied in, in a stock proof manner to any adjacent boundary fence.

The council has covenanted that Revell Tennant Baker (hereinafter called “the vendor”) shall not be liable or called upon to contribute towards the costs of erection or maintenance of any dividing or boundary fence between the land acquired or the easement and any adjoining land belonging to the vendor, but this provision shall not enure to the benefit of any purchaser or purchasers from the vendor of any such adjoining land.

This easement shall be forever appurtenant to the land firstly described in the First Schedule herein.
