Pursuant to sections 116 and 117 (7) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, declares the piece of road described in the Schedule hereto to be stopped and when so stopped to be known as Section 1 on S.O. Plan 52074 and to be added to the adjoining land held for a university, being part of the land comprised in Proclamation 18450, North Auckland Land Registry.

Land and Interests Over Land Acquired for Water Supply Purposes in Manukau City

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, declares that agreements to that effect having been entered into, the land described in the First Schedule, the rights of way easement in gross described in the Second Schedule over the land described in the Third Schedule, the water supply tunnel easement in gross described in the Fourth Schedule over the land described in the Fifth Schedule and the drainage easement in gross described in the Sixth Schedule over the land described in the Seventh Schedule is hereby acquired for water supply purposes and the said land shall vest in The Auckland Regional Council on the date of publication in the Gazette.

Second Schedule

North Auckland Land District (Description of Rights of Way Easement)

1. Pointways Pony Club Incorporated, an incorporated society under the Incorporated Societies Act 1908 and Robert Henry Van Gisbergen of Auckland, assistant sales manager (hereinafter together with their heirs, successors and assigns called “the owners”) are the grantors and The Auckland Regional Council (hereinafter called “the council”) is the grantee of a rights of way easement in gross and in perpetuity over the land described in the Third Schedule (hereinafter called “the easement land”) upon the terms and conditions set forth in the Seventh Schedule of the Land Transfer Act 1952 and implied in all registered easements by section 90 of the said Act and as modified by the following terms and conditions:

(a) place any buildings, erections or fences or permanent improvements of any nature;

(b) do permit or suffer any act whereby the rights, powers, licences and liberties hereby granted to the council may be interfered with or affected; or

(c) do permit or suffer any act whereby the said right of way may be interfered with or damaged.

3. That where the terms of the Easement require the consent of the council to be obtained in respect of any matter herein referred to then the council shall not unreasonably or arbitrarily withhold such consent.

4. The council shall form a roadway (hereinafter called “the road”) to provide vehicle access from Redoubt Road to its water supply tunnel and will at all times repair and maintain the road in pursuance of these presents in a good and efficient state of repair for the purposes for which it has been constructed and will prevent the same from becoming a nuisance.
