Land and Interests Over Land Acquired for Defence Purposes and Easements Partially Surrendered in the City of Auckland (Great Barrier Island)

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, hereby declares:

(1) Pursuant to section 42 (4), the Crown hereby surrenders the portions of the easements taken by Proclamation published in Gazette, 15 March 1962, No. 16, page 420 (Proclamation 18942, North Auckland Land Registry) as to the land described in the First Schedule to the extent that they shall merge with the servient tenement therein described.

(2) Pursuant to section 20, that an agreement to that effect having been entered into, the land described in the Second Schedule, the line of sight easement described firstly in the Third Schedule over the land described in the Fourth Schedule, the right of way easement secondly described in the Third Schedule over the land described in the Fifth Schedule and the cable easement thirdly described in the Third Schedule over the land described in the Sixth Schedule are hereby acquired for defence purposes and shall vest in the Crown on the date of publication of this declaration in the Gazette and that those remaining easements created by Proclamation 18942, North Auckland Land Registry, shall with the easements herein acquired be forever appurtenant to the land described in the Eighth Schedule hereto.
