Summary of Bills Introduced

Imprest Supply Bill (No. 4)

This bill enables the issue and application of certain amounts of public money towards the service of the year ending with the 30th day of June 1993 and to authorise costs to be incurred towards the service of that year.

Lake Pukaki Water Level Empowering Bill

The purpose of this bill is to provide statutory authority for the Electricity Corporation of New Zealand Ltd to lower Lake Pukaki below the minimum level fixed in the Corporation’s current water permit, for a limited period. When this period expires the Act will be deemed to be repealed and, any alteration to the minimum level will be dealt with under the Resource Management Act 1991.

Dumping and Countervailing Duties Act 1988

Final Determination and Imposition of Anti-Dumping Duty: Lead Acid Batteries from the Philippines

Pursuant to section 13 (1) of the Dumping and Countervailing Duties Act 1988, (hereinafter referred to so as “the Act”), I, Philip Burden, Minister of Commerce, hereby give notice that I have made a final determination that the goods specified in the First Schedule to this notice (hereinafter referred to as “subject goods”) imported or intended to be imported into New Zealand, are goods in respect of which I may direct the imposition of anti-dumping duty in accordance with section 14 of the Act.

I hereby give notice that I am satisfied in relation to the importation, or intended importation, into New Zealand of the subject goods that—

(a) The subject goods are being dumped; and

(b) By reason thereof material injury to the New Zealand lead acid battery industry is threatened,—

and state that section 14 of the Act applies to the subject goods, and that there shall be charged, collected and paid on demand of the Collector of Customs anti-dumping duty on the subject goods. The anti-dumping duty so imposed shall be the appropriate amount specified in the Second Schedule to this notice in relation to the source and supplier of the importation.

First Schedule

Subject Goods

Lead acid automotive replacement batteries for the passenger motor vehicle market and marine applications (excluding DIN batteries and deep cycle marine batteries), originating in the Philippines.

The goods are currently classifiable under Tariff Item and Statistical Key 8507.10.09.00E of the Tariff of New Zealand. The Tariff Item and Statistical key is provided for convenience and Customs purposes. The written description is dispositive.

Second Schedule

Amount of Anti-Dumping Duty

The following anti-dumping duty, expressed as a percentage of the value for duty of the subject goods, shall be charged, collected and paid on demand of the Collector, in respect of the subject goods:

Category III: Subject goods with nominal footprint dimensions, in millimetres, of:

Length: 208–260; Width: 170–176; Terminal Height: 190–230.

Preliminary Determination: Polyvinyl Chloride (PVC) Cling Film From Korea and Taiwan

Pursuant to section 12 (1) of the Dumping and Countervailing Duties Act 1988, I, Philip Burdon, Minister of Commerce, hereby give notice that I have made a preliminary determination on the basis of the information made available during the investigation, that there is reasonable cause to believe that the goods subject to investigation described in the schedule to this notice, and imported or intended to be imported into New Zealand, are goods in respect of which I may direct the imposition of an anti-dumping duty in accordance with section 14 of the Dumping and Countervailing Duties Act 1988.

Polyvinyl Chloride (PVC) cling film, of gauges between 7 and 32 microns, and a width of 195 millimetres or more
