Public Works Act 1981

Notice of Intention to Take Land

Notice is hereby given that The Christchurch City Council proposes to take under the provisions of the Public Works Act 1981 all that parcel of land described in the Schedule for the purposes of a public road, pursuant to the provisions of section 322 of the Local Government Act 1974. The reasons why the taking of the land is reasonably necessary are:

(a) Part of the land is required for road, a public work within the meaning of the Public Works Act 1981, and is necessary for the construction of the realignment to an appropriate standard for a minor arterial and is the only whole property acquisition required for construction to commence.

(b) Part of the land is required for the functioning of a road to prevent access to the realignment for traffic management purposes.

(c) The ability to amalgamate the balance of the land with other surplus land (which land is not of a size or shape to enable its sale or disposition as a separate parcel of land arising from the road realignment) is a cost efficient use of public funds.

(d) The public work has been included in the district planning scheme since December 1979.

(e) Provision has been made in the council’s works programme for the work to be commenced in the 1990/91 financial year.

Any person having an estate or interest in the land may forward a written objection to the Registrar, Planning Tribunals Division, Justice Department, Private Bag, Postal Centre, Wellington within 20 working days of the publication of this notice.

Schedule

Canterbury Land District

All that parcel of land situated in the City of Christchurch containing 1193 square metres or thereabouts being part Rural Section 6 and being all of the land comprised and described in certificate of title, Volume 21F, folio 1179.

The above description refers to an irregular shaped parcel of land situated at 9 Carlton Mill Road, Christchurch.
