Advertisement of Application for Winding Up of a Company by the Court

Take notice that on the 14th day of March 1991, an application for the winding up of Waitotara Bulk Supplies by the High Court was filed in the High Court at New Plymouth.

The application is to be heard before the High Court at New Plymouth on Thursday, the 20th day of June 1991 at 10 o’clock in the forenoon.

Any person, other than the defendant company, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before that day.

The applicant is Europa Oil NZ Limited, whose solicitors are NJH Smith & Co, Lower Hutt, whose address for service is Baycorp House, 14–16 Kings Crescent (P.O. Box 30-268), Lower Hutt.

Notice of Meeting of Creditors Where Winding Up Resolution Passed by Entry in Minute Book

Pursuant to Section 362 of the Companies Act 1955

In the matter of the Companies Act 1955, and in the matter of Fletcher-Newman (NZ) Ltd.:

Notice is hereby given that by entry in its minute book, signed in accordance with section 362(9) of the Companies Act 1955, the above-named company on the 24th day of May 1991 passed a resolution for voluntary winding up, and that a meeting of the creditors of the above-named company will accordingly be held at the office of the Commercial Affairs Division, Seventh Floor, Justice Departmental Building, 3 Kingston Street, Auckland on Friday, the 7th day of June 1991 at 10.30 o’clock in the forenoon.

Business:

  1. Consideration of a statement of the position of the company’s affairs and list of creditors, etc.
  2. Nomination of liquidator.
  3. Appointment of committee of inspection if thought fit.

Notice of Meeting of Creditors

Notice is hereby given that at a meeting of Syrena Developments Ltd. held on the 28th day of May 1991, a resolution for voluntary winding up of the company was passed by entry in the minute book of the company pursuant to section 362 and that a meeting of creditors of the company will be held pursuant to sections 284 and 362(8) of the Companies Act 1955, at the offices of Messrs Renshaw Edwards Basil-Jones, Solicitors, First Floor, Legal House, 6 Margaret Street, Lower Hutt on the 7th day of June 1991 at 4.30 o’clock in the afternoon at which meeting a full statement of the position of the company’s affairs together with a list of creditors and estimated amounts of their claims will be laid before the meeting and at which meeting the creditors pursuant to section 285 of the Act may nominate a person to be a liquidator of the company and in pursuance of section 286 of the Act may appoint a committee of inspection.

That the company cannot by reason of its liabilities continue its business and that it is advisable to wind up, and that accordingly, the company be wound up voluntarily.
