Notice of Appointment of Receivers and Managers

Pursuant to Section 346 (1) of the Companies Act 1955

The Bank of New Zealand with reference to Kapiti Building Services (1989) Ltd., hereby gives notice that on the 15th day of March 1991, the bank appointed Keith Frederick Ardern and Jack Peter Poutama, both chartered accountants, whose offices are at Fletcher Poutama Whitelaw & Co, Chartered Accountants, Kerikeri Road, Kerikeri, jointly and severally as receivers and managers of the property of this company under the powers contained in an instrument dated the 17th of February 1989.

The receivers and managers have been appointed in respect of all the company’s undertaking and all its real and personal property and all its assets and effects, whatsoever and wheresoever, both present and future, including its uncalled and unpaid capital.

Westpac Banking Corporation hereby given notice that on the 15th day of March 1991, it appointed Peter John Morgan Taylor and William John Henry Stewart, chartered accountants, whose office is care of Ernst & Young, Ernst & Young House, corner of Marine Parade and Vautier Street (P.O. Box 1145), Napier, as receivers and managers of all the assets of the above company under the power contained in an instrument dated the 17th day of December 1980 being a debenture from Primary Export Services N.Z. Ltd. (formerly Fruit and Produce Growers Export Company of New Zealand Ltd.) to Westpac Banking Corporation.

The National Bank of New Zealand Ltd., being the registered holder of a debenture, dated the 16th day of December 1985, issued by Te Kuiti Hotel Ltd., hereby gives notice that on the 19th day of March 1991, under the powers contained in the debenture, it appointed Peter Ross McLean and Stuart Raymond Cann of Hamilton, chartered accountants, to be joint and several receivers and managers of the property of the company.

The office of the receivers and managers is at the offices of Beattie Rickman, Beattie Rickman Centre, corner of Bryce and Anglesea Streets, Hamilton.

Take notice that on the 28th day of February 1991, an application for the winding up of Hyperperformance Systems Limited by the High Court was filed in the High Court at Auckland.

The application is to be heard before the High Court at Auckland on Thursday, the 23rd day of May 1991 at 2.15 p.m.

Any person, other than the defendant company, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before that day.
