Notice of Intention to Take Land

Pursuant to Section 23, Public Works Act 1981

Take notice that the Upper Hutt City Council proposes to take the land described in the Schedule hereto, for road.

The land concerned is a section of the Mangaroa Valley Road, approximately 1600 metres in length, running east from a point about 50 metres from the junction of Mangaroa Valley Road with Wallaceville Road and Whitemans Valley Road. The land concerned is the sealed carriageway and berms of the Mangaroa Valley Road.

The land has been maintained as a road out of public money for many years. Originally, it was maintained by the Hutt County Council, but since 1972 it has been maintained by the Upper Hutt City Council as road.

Plans (being Survey Office Plans 34661 and 36108) of the land to be taken, have been prepared and lodged with the Chief Surveyor. Copies of the plans may be inspected at the offices of the Upper Hutt City Council Reception, Level 2, Civic Administration Building, 838-842 Fergusson Drive, Upper Hutt, at any time when the office is open for business, until 1 p.m. on Friday, 22 March 1991.

Any person having any estate or interest in the land may object to the Planning Tribunal against the proposed taking of the land. Any other person also (whether claiming an interest in the land or not) may also object to the Planning Tribunal against the proposed taking of the land.

Every objection must be made in writing and lodged with the Registrar of the Planning Tribunal (175 The Terrace, P.O. Box 10-044, Wellington) by no later than 1 p.m. on Friday, 22 March 1991. A copy of the objection is also to be served on the Upper Hutt City Council at its address aforesaid.
