Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland declares that an agreement to that effect having been entered into, the land described in the Schedule is acquired for road and shall vest in The Rodney District Council on the date of publication in the Gazette.

A Right of Way Easement in Gross Acquired for Mill Road Reservoir in Manukau City

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands the Manager, Lands and Property, Department of Survey and Land Information, Auckland, declares that an agreement to that effect having been entered into, the right of way easement in gross described in the First Schedule is hereby acquired over the land described in the Second Schedule and the said easement shall vest in perpetuity in The Auckland Regional Council on the date of publication in the Gazette.

Description of Easement

  1. Murray Coleman Cleave of Auckland, electrician and Alma Jill Cleave of Manurewa, married woman, being the registered proprietors of the land described in the Third Schedule (hereinafter called “the owners land”) (hereinafter together with their heirs, successors and assigns called “the owners”) are the grantors and The Auckland Regional Council (hereinafter called “the council”) is the grantee of a right of way easement in gross and in perpetuity, over the land described in the Second Schedule (hereinafter called “the easement land”) upon the terms and conditions set forth in the Seventh Schedule of the Land Transfer Act 1952 as modified by the following terms and conditions.

  2. The owners shall not at any time on or over the easement land without prior written consent of the council.

    (a) Place any buildings errctions or fences or permanent improvements of any nature;

    (b) Do permit or suffer any act whereby the rights, powers, licences and liberties hereby granted to the council may be interfered with or affected; or

    (c) Do permit or suffer any act whereby the road and ancillary retaining walls may be interfered with or damaged.

  3. That where the terms of this easement require the consent of the council to be obtained in respect of any matter herein referred to, then the council shall not unreasonably or arbitrarily withhold such consent.

  4. The council may construct and form a road and ancillary retaining walls over the easement land and will.

    (a) Construct and form such road and ancillary retaining
