Survey and Land Information

Public Works Act 1981

Declaring Land to be Road, Road Stopped, Land Taken and Land Acquired for Soil Conservation and River Control Purposes in the Clutha District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager (Lands and Property), Department of Survey and Land Information, Dunedin:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Clutha County Council.

(b) Pursuant to sections 116 and 117, the road described in the Second Schedule hereto to be stopped and declares that:

(i) The areas marked “C” and “E” on S.O. Plan 21976 and “I” on S.O. Plan 21977 shall be amalgamated with the land in deferred payment licence No. 5C/782.

(ii) The areas marked “H” and “L” on S.O. Plan 21977 and “Q” on S.O. Plan 21978 shall be amalgamated with the land in certificate of title No. 294/196.

(iii) The area marked “U” on S.O. Plan 21978 shall be amalgamated with the land in deferred payment licence No. 5C/266.

(iv) The area marked “V” on S.O. Plan 21978 shall be amalgamated with the land in certificate of title No. 350/249.

(v) The areas marked “B” and “D” on S.O. Plan 20367, the areas marked “J” and “M” on S.O. Plan 20369 and the areas marked “W”, “O” and “Y” on S.O. Plan 20370 shall be amalgamated with the land in deferred payment licence No. 3D/1443.

(vi) The area marked “I” on S.O. Plan 20369 shall be amalgamated with the land in certificate of title No. 399/89.

(vii) The area marked “S” on S.O. Plan 20370 and the areas marked “B” and “E” on S.O. Plan 20371 shall be amalgamated with the land in certificate of title No. 5B/385.

(viii) The areas marked “C” on S.O. Plan 20371, “D” on S.O. Plan 21033 and “E” on S.O. Plan 21034 shall be amalgamated with the land in deferred payment licence No. 11A/375.

(ix) The areas marked “N” on S.O. Plan 21037 and “O” on S.O. Plan 21038 shall be amalgamated with the land in certificate of title No. 3D/1194.

(x) The area marked “K” on S.O. Plan 22859 shall vest in The Clutha District Council.

(i) The areas marked “A”, “C” and “E” on S.O. Plan 22859 shall vest in The Otago Regional Council for the purposes of soil conservation and river control.

(ii) The area marked “H” on S.O. Plan 20369 shall be amalgamated with the land in certificate of title No. 399/89.

(iii) The area marked “T” on S.O. Plan 20370 shall be amalgamated with the land in certificate of title No. 5B/385.

(d) Pursuant to sections 191 and 114, hereby authorises the application of the land described in the Fourth Schedule hereto being land held primarily for soil conservation and river control purposes, to the secondary use of road and the control and management of the secondary use shall vest in The Clutha District Council.
