Scheme for Varying the Mode of Administering The Bowen Hospital Trust

In the matter of the Charitable Trust Act 1957, and in the matter of a deed of trust dated 17 March 1964 constituting The Bowen Hospital Trust—The Bowen Hospital Trust Board, a board duly incorporated under the provisions of the Charitable Trusts Act 1957—Applicants:

Take notice that on the 19th day of August 1991, at 10 a.m. or so soon thereafter, as counsel may be heard, the applicants will move the Court at Wellington for orders approving the scheme to vary the mode of administering The Bowen Hospital Trust, and varying the deed of trust accordingly.

1. It is proposed to delete the existing clause 2 (b) of the deed of trust dated 17 March 1964, constituting The Bowen Hospital Trust, and to substitute the following:

"The trustees from time to time of these presents shall consist (subject as hereinafter provided) of 7 lay trustees and 3 medical trustees who shall be associate medical practitioners (as hereinafter defined).

2. It is proposed to delete clause 2 (h) of the said deed of trust.

3. The effect of this will be to increase the number of trustees from 5 or 6 lay trustees and 2 medical trustees to 7 lay trustees and 3 medical trustees.

Any person desiring to oppose the scheme is required to give written notice of his intention to the Registrar of the Court and to the Attorney-General and to the applicants whose address for service is at the offices of Morrison Morpeth, Solicitors, Nineteenth Floor, Marac House, 105–109 The Terrace, Wellington, not less than 7 clear days before the 19th day of August 1991.
