A Water Drainage Easement in Gross Acquired in Connection with a Road in South Waikato District

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Hamilton, declares that, an agreement to that effect having been entered into, an easement in gross to drain water is described in the First Schedule hereto is hereby acquired in connection with a road over the land described in the Second Schedule hereto, and further declares that the said easement shall vest in the Crown on the date of publication hereof in the Gazette.

First Schedule

South Auckland Land District

Description of Easement
The rights and powers implied in and attaching to a right to drain water easement as set out in the Seventh Schedule to the Land Transfer Act 1952 under the heading “Right to Drain Water” as if the same were fully set out herein, provided that:

1. The Crown will maintain and keep in good repair the easement to a standard sufficient in the opinion of the Crown to enable the registered proprietors of the land in the Second Schedule (called “the owners”), their assigns and successors in title to satisfactorily carry out their normal farming business, provided that such maintenance and repair is not attributable to the neglect or default of the owners, their servants or invitees.

2. That the owners will give the Crown prompt notice in writing of any defect or want of repair to the easement and that the Crown shall not be liable for any deterioration or damage unless in receipt of such notice and the Board shall within reasonable times thereafter to its satisfaction remedy such defect.

Land Over Which Easement is Acquired

2247 square metres, situated in Block II, Atiamuri Survey District, being part Lot 1, D.P. S. 4307, as shown marked “B” on S.O. Plan 56532, lodged in the office of the Chief Surveyor at Hamilton.

(a) Pursuant to section 20 (1), declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for road which, pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway No. 6, and shall vest in the Crown on the date of publication hereof in the Gazette.
