ORDER IN COUNCIL

At Wellington this 10th day of December 1990

Present:
His Excellency THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

Pursuant to sections 24 (1) and 28 of the State-Owned Enterprises Act 1986 and section 25 (j) of the Acts Interpretation Act 1924, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

Order

  1. Title—This order may be cited as the State-Owned Enterprises (Landcorp Farming Limited Vesting Order No. 5) Order 1990.

  2. Application—This order applies to all the land described in the Schedule to this order, saving and excepting—

    (a) The bed of any navigable river (within the meaning of section 261 of the Coal Mines Act 1979); and

    (b) The bed of any river or stream that has an average width of 3 metres or more; and

    (c) The bed of any lake that has an area (calculated on the basis of its normal level or maximum control level) and the normal level or maximum control level of all its bays and inlets) of more than 8 hectares; and

    (d) The bed of any bay or inlet of any such lake.

  3. Approval and vesting—The land to which this order applies—

    (a) Is hereby approved for the purposes of section 24 (1) (b) of the State-Owned Enterprises Act 1986; and

    (b) On the 14th day of December 1990 shall vest for an estate in fee simple in Landcorp Farming Limited (a company duly incorporated under the Companies Act 1955, having its registered office at Wellington, and being a State enterprise within the meaning of section 29 (1) of the State-Owned Enterprises Act 1986),—

     (i) Together with the appurtenant rights (if any) described in the Schedule to this order; but
    
     (ii) Subject to the rights, interests, and incumbrances, (if any) to which it is described in the Schedule to this order as being subject.
  4. Consequential amendments—The Schedule to the State-Owned Enterprises (Landcorp Farming Limited Vesting Order No. 3) is hereby consequentially amended by—

    (a) Omitting from the second column of the description of the land thirdly described in that schedule the expression “Sections 28 and 29”, and substituting the expression “Section 28”; and

    (b) Omitting from the first column of that description the expression “912.0355 ha”, and substituting the expression “838.4156 ha”.

The State-Owned Enterprises (Landcorp Farming Limited Vesting Order No. 3) vested certain land in Landcorp Farming Limited, a subsidiary of a State enterprise. Part of the land was described in the order as “Sections 28 and 29, Block XII, Mangakahia Survey District”. The reference to section 29 was a mistake, and the number should have been 39. This order, which comes into force on 14 December 1990, vests section 39 in Landcorp Farming Limited, and amends the earlier order accordingly.
