(2) In this notice—“Foulhook” in relation to sports fish means to take a sports fish with a hook otherwise than from within the mouth.
(3) In this notice all dates specified are included in the period quoted.
- Open season—(1) No licence holder shall fish for or take any sports fish except during an open season.
(2) Subject to subclause (3) of this clause and to clause 4 of this Notice, there shall be an open season for fishing for sports fish from the 1st day of October in any year to the 30th day of April in the following year.
(3) There shall be an open season for fishing for sports fish:
(a) From the 1st day of June to the 31st day of August in the same year in the Ashburton, Rangitata and Waitaki Rivers downstream from their bridges on the Main South Road;
(b) From the 1st day of May to the 31st day of August in the same year in Lakes Tekapo and Aviemore;
(c) From the 1st day of October in any year to the 30th day of September in the year following in the Pukaki-Ohau, Tekapo-Pukaki, Ruataniwha-Ohau “B” and Ohau “C” hydro canals, in Lakes Benmore, and Ruataniwha and the Waitaki Arm of Lake Ruataniwha, and in the Rangitata Diversion Race from the intake downstream to Rakaia River Road;
(d) From the 1st day of May to the 31st day of May in the same year in Lake Camp.
- Closed season—(1) There shall be a closed season for fishing for sports fish:
(a) From the 1st day of October to the Friday preceding the first Saturday in November in the same year in Lakes Clearwater, Emma, Maori Lakes, Denny, Roundabout, Emily, Camp, Spider, Donne, Alexandrina, McGregor, Ohau, and Middleton, or any high-country tarn, or in Deep Stream east of the bridge where it enters Lake Aviemore, or in the Ahuriri, Otamatata River and Ohau Rivers, or in the Tekapo River upstream of a line running beneath the lower powerlines across the river, or in tributaries of the said lakes, tarns and rivers;
(b) From the 1st day of March to the 30th day of April in the same year in the Rangitata River and its tributaries above the point known as Red Rocks Bluff, that point being more particularly shown by white posts on the river banks;
(c) From the 1st day of February to the 30th day of April in the same year in Larch Stream;
(d) From the 1st day of February to the 30th day of April in the same year in that part of the Waitaki River enclosed by a line drawn from the site of a white post on the north bank situated approximately 100 m west of the Waitaki Salmon Company’s fish farm discharge channel; to the site of a white post set opposite on the riverbed; then downstream in a generally easterly direction to the site of a white post situated approximately 100 m east of the aforesaid discharge channel; then to the site of a white post set opposite on the north bank; then in a generally westerly direction along the north bank to the point of commencement; or the Waitaki Salmon Company’s fish farm discharge channel between Bells Pond and the Waitaki River.
(e) From the 1st day of October in any year to the 30th day of September in the following year—
(i) In the outlet creek between Lake Alexandrina and Lake McGregor.
(ii) In any boat harbour or from either side of any mole at any boat harbour in Lake Aviemore or Lake Benmore.
(iii) In McKinnons Stream, a tributary to the south side of the lower Rangitata River.
(f) From the 1st day of April to the 30th day of April in the same year, in Bowyers Stream, Taylors Stream or in the south branch of the Ashburton River and its tributaries from its source downstream to its confluence with Taylors Stream.
(2) There shall be a closed season for fishing for salmon from the 1st day of April to the 30th day of April in the same year in the Waitaki River between the Waitaki Dam and a line running beneath the power lines across the river at the Stonewall, or in any tributary of that part of the River.
- Authorised tackle—(1) No licence holder shall fish for or take any sports fish except by using a rod and running line.
(2) Notwithstanding subclause (1) of this clause, when playing a sports fish, a landing net or gaff may be used to secure or land any such fish.
(3) No licence holder shall, in fishing for, or taking sport fish, use or have under their control, more than one assembled rod and running line.
(4) No licence holder shall fish for sports fish unless within 15 metres of the rod being used and has the rod under visual observation.
(5) No licence holder when fishing for sports fish shall use—
(a) More than 2 lures or baits;
(b) Any lead or weight attached below or so as to hang below any lure or bait;
(c) In any water in which only artificial fly is permitted, any lead or weight other than the necessary weight of line, cast and fly;
(d) Any artificial fly having more than one hook or having a multiple hook;
(e) Any bait or lure treated with any medicinal or chemical preparation other than:
(i) In the case of artificial fly, oil used solely to give buoyancy to such flies; and
(ii) In the case of natural baits, a formalin or other preservation preparation;
(f) Any wire, either plain or twisted, except when trolling in Lakes Waitaki, Aviemore, Benmore, Ohau, Pukaki or Tekapo;
(g) On or in conjunction with any fly, spoonbait, minnow, or other lure any single or fixed multiple assembly of hooks any one hook of which has a greater distance than 13 mm between the point and the nearest part of the shank of the hook;
(h) In conjunction with any spoonbait or artificial minnow, any lead or weight affixed to the trace or line at a distance of less than 38 cm above the lure;
(i) Any unsportsmanlike device or method.
(6) No licence holder when fishing for sports fish shall—
(a) Fish from any boat or other floatation device in Lakes Camp, Roundabout, Denny, Emily, Donn, or Spider;
(b) Fish from any unmoored boat or floatation device in Lakes McGregor, Alexandrina, Middleton, Emma, Clearwater, or the Maori Lakes;
(c) Subject to subclauses (6) (a) and (6) (b) of this clause, fish from any boat in any other lake within 100 metres of any person fishing from the shore of that lake;
(d) From the 1st day of January to the 30th day of April in the same year, use in the Ashburton, Rangitata, Orari, or Opihi Rivers or their tributaries, more than one lure or bait when any weight is attached, or more than one hook (single or multiple), or any hook with a gap greater than 13 mm;
(e) Cast other than by hand from the reel, or retrieve the line other than by winding the reel, in the Ashburton, Rangitata, Orari, or Opihi Rivers except when—
(i) Using an artificial fly or natural bait (except where this is otherwise prohibited);
(ii) Fishing with a single hook feathered lure (the total weight of which must not exceed 28 grams) seaward of
