An Easement Acquired Over Land for the Purposes of Sewage Works in the Clutha District

Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager (Lands and Property), Department of Survey and Land Information, Dunedin, declares that an agreement to that effect having been entered into, the easement described in the First Schedule hereto to be held appurtenant to the land described in the Second Schedule hereto is hereby acquired for the purposes of sewage works over the land described in the Third Schedule hereto and shall vest in The Clutha District Council on the 23rd day of August 1990.

Description of Easement Acquired

In order to construct, maintain, repair or replace such items connected with the adjoining sewage oxidation ponds, the full free and unrestricted right for the agents and workers of The Clutha District Council to pass over the said land with or without the necessary vehicles, implements, tools and materials for the purpose aforesaid.

All that piece of land containing 6815 square metres, being Lot 1, D.P. 20309 and being part Section 8, Block XII, North Molyneux District. All certificate of title No. 12B/1429.

Third Schedule

Otago Land District—Clutha District

All that piece of land containing 31 square metres, being part Section 8, D.P. 3209, Block XII, North Molyneux Survey District; shown marked ‘A’ on S.O. Plan 22965, lodged in the office of the Chief Surveyor at Dunedin.
