Broadcasting Standards Authority

Broadcasting Act 1989

Decisions No. 1/90 and No. 2/90

Pursuant to section 15 (1) of the Broadcasting Act 1989, notice is hereby given that the Broadcasting Standards Authority, at its meeting in Wellington on 18/19 January, made decisions on two complaints concerning programmes broadcast on television.

In Decision No. 1/90, the Authority declined to uphold a complaint by C. R. Turner that a rugby league advertisement by Lion Red Limited breached rules on “liquor advertising”. The Authority held that the advertisement was “sponsorship advertising” and, as such, not in breach of the “liquor advertising” rules.

In Decision No. 2/90, the Authority declined to uphold a complaint by Patricia Bartlett, for the Society for Promotion of Community Standards, that in broadcasting The Nightworkers documentary on TV1 in August 1989, Television New Zealand Limited had failed in its obligation under section 4 (1) (a) of the Act to maintain standards consistent with the observance of good taste and decency. After finding that the programme was a balanced and informative documentary, screened at an appropriate time and with appropriate censorship classification, the Authority agreed with TVNZ Limited that, within its context, the documentary was not inconsistent with the broadcaster’s responsibility under section 4 (1) (a) to maintain, in its programmes and their presentation, standards consistent with the observance of good taste and decency.

Land in Otago Land District Forfeited

Pursuant to section 146 of the Land Act 1948, notice is hereby given that Landcorp Investments Limited at Wellington with the approval of the Minister of Lands, has by resolution declared the licence described in the Schedule hereto forfeited, and that the land is hereby reverted to Landcorp Investments Limited.

Public Works Act 1981

Declaring Easement Over Land Acquired for Water Supply Purposes in the District of Napier

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Lands, Napier, declares that, an agreement to that effect having been entered into, the following easement in gross is acquired for water supply purposes (and may be surrendered at any time by notice in the Gazette) vesting in the Napier District Council (called the grantee) the date of publication of this declaration in the Gazette the right to convey water by means of underground 155 mm UPVC water pipes through the land described in the Schedule. There shall be implied in the foregoing easement in gross the rights and powers set out in the Seventh Schedule to the Land Transfer Act 1952.
