take any proceedings against a co-trustee for any breach or alleged breach of trust committed by such co-trustee.

"(e) The persons appointed as trustees pursuant to this clause shall be substituted for their predecessors."

(iii) Deleting clause 12 and substituting the following clause:

"12. Power to Apply for incorporation

The trustees shall be empowered by this deed to apply for incorporation under Part II of the Charitable Trusts Act 1957 under the name ‘The Auckland Rescue Centre Trust Board’, and upon such incorporation the powers conferred upon the trustees shall thereupon be conferred upon them as a trust board."

(iv) Deleting clause 16 and substituting the following clause:

"16. Alteration of Trusts

It shall be in order for the Auckland Regional Council and the Secretary for Internal Affairs by agreement between them to revoke, vary, or add to any of the provisions of this Deed so long as such revocation, variation, or addition is not inconsistent with the general charitable scope of this Deed."

(b) Subject to the amendments in paragraph (a) of this subclause the Auckland Harbour Rescue Centre Trust shall continue in effect.

His EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 624 (2) of the Local Government Act 1974, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

Order

  1. Title and commencement—(1) This order may be cited as the Local Government (Earthquake Dangers) Order 1990.

(2) This order shall come into force on the day after the date of its notification in the Gazette.

  1. Tararua District Council authorised to exercise powers under section 624 of Local Government Act 1974—The Tararua District Council is hereby declared to be a council to which section 624 of the Local Government Act 1974 applies.

Explanatory Note

This note is not part of the order, but is intended to indicate its general effect.

This order empowers the Tararua District Council to exercise the powers conferred by section 624 of the Local Government Act 1974 in relation to buildings likely to be dangerous in a moderate earthquake.
