Appointment of Member of the Commerce Commission

Pursuant to section 9 of the Commerce Act 1986, His Excellency the Governor-General has been pleased to appoint

Michael Campbell Copeland of Wellington

to be a member of the Commerce Commission for a period of 2 years commencing from the 23rd day of July 1990.

Conservation Act 1987

Appointment and Revocation of Appointment to Transitional Northland Fish and Game Council

Pursuant to section 26N of the Conservation Act 1987 (as inserted by section 17 of the Conservation Law Reform Act 1990), the Minister of Conservation hereby:

(i) revokes the appointment of

Eric Wellington of Whangarei

as a member of the Transitional Northland Fish and Game Council; and

(ii) appoints

Trevor Payton of Kaitaia, builder/distributor

to be a member of the Transitional Northland Fish and Game Council for a term expiring 4 May 1991.

The Western Bay of Plenty District Foreshore Control Order 1990

ORDER IN COUNCIL

At Wellington this 23rd day of July 1990

Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 165 of the Harbours Act 1950 His Excellency the Governor-General, on the recommendation of the Minister of Conservation and acting by and with the advice and consent of the Executive Council, hereby makes the following order.

Order

  1. Title and commencement—(1) This order may be cited as the Western Bay of Plenty District Council Foreshore Control Order 1990.

(2) This order shall come into force 28 days after its publication in the Gazette.

  1. Interpretation—In this order—

“The Act” means the Harbours Act 1950:

“The Council” means the Western Bay of Plenty District Council:

“Foreshore” means such parts of the bed, shore, or banks of tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides.

  1. Grant of control—There is hereby granted to the Council for a period of 21 years from the commencement of this order, control of the foreshore described in the Schedule to this order.

  2. Conditions of grant—The grant of control conferred by clause 3 of this order is subject to the following conditions—

(1) Suitably worded signs shall be erected at main access ways to the foreshore described in the Schedule to this order indicating that control of it has been granted the Council pursuant to section 165 of the Act.

(2) All money received by the Council in the performance or exercise of the functions, duties or powers conferred on it by this order in respect of the foreshore to which this order applies, shall after the deduction of any expenditure incurred by the Council in the performance or exercise of those functions, duties or powers, be applied to the construction, repair or improvement of facilities in respect of the foreshore and not otherwise.

Schedule

All that area of the foreshore being adjacent to that part of the Waihi Beach situated in the Western Bay of Plenty District, South Auckland Land District, bounded by a line commencing at the north-eastern corner of section 87, Block I, Katikati Survey District and its common boundary with the Mean High Water Mark to its intersection with a line bearing 168 true from Bench Mark Number AQ92 situated in Block XIII, Katikati Survey District, as more particularly delineated on plan No. DOC(CM)RO41 deposited in the Rotorua Conservancy Office of the Department of Conservation.

Appointment and Revocation of Supervising Officers

  1. Thomas Edwin Law, Senior Advisory Officer (Harbours Management), pursuant to section 7 of the Harbours Act 1950 and in exercise of powers delegated to me pursuant to sections 8 and 9 of the Ministry of Transport Act 1968, hereby appoint:

Douglas David Brown, as a supervising officer for New Zealand

Leslie Allan Porter, as a supervising officer for New Zealand

Peter Edwin Vosser, as a supervising officer for New Zealand

and hereby revoke the appointment of

Jennifer Alan Chirnside*

as a supervising officer for New Zealand

for the purposes of the Harbours Act 1950 and the Water Recreation Regulations 1979.
