Securities Act 1978

Proposed Recommendation for Regulations About the Futures Industry (Client Funds)

Pursuant to section 70 (3) of the Securities Act 1978 (as applied by section 41 (2) of the Securities Amendment Act 1988), notice is hereby given that the Securities Commission intends to make a recommendation for the making of regulations.

The recommendation relates to the making of regulations relating to the receipt of money and property from clients by persons dealing in futures contracts and the application and protection of that money. The proposed regulations will:

(a) Provide for the establishment and maintenance of client bank accounts and client funds accounts by dealers in futures contracts:

(b) Require client money to be paid into or credited to those accounts:

(c) Prescribe the obligations of dealers and other persons in relation to client bank accounts and client funds accounts:

(d) Restrict the disbursements of client money from client bank accounts and the debiting of amounts to client funds accounts:

(e) Prescribe requirements relating to the deposit of client property in safe custody:

(f) Restrict the availability of client money and client property to meet liabilities of the dealer or other persons:

(g) Give further protection to client money and client property in cases where the dealer is insolvent:

(h) Prescribe conditions relating to certain client investments:

(i) Require dealers to keep accounting and other records in relation to client bank accounts, client funds accounts, and client property:

(j) Provide for the auditing of those accounting records:

(k) Prescribe offences for contravention or failure to comply with the regulations.

A copy of the proposed recommendations may be inspected at the offices of the Commission, Level 6, Greenock House, 39 The Terrace, Wellington.

Reserves Act 1977

Revocation of a Notice Relating to a Reserve and Issue of a Fresh Notice

Pursuant to section 6 (3) of the Reserves Act 1977, the Otago Regional Conservator, Department of Conservation acting under delegated authority from the Minister of Conservation hereby revokes the notice authorising the exchange of part of a reserve for other land dated the 14th day of July 1989 and published in New Zealand Gazette of 27 July 1989, No. 130, page 3217 and hereby issues the following notice as a fresh notice in its place.

Authorisation of the Exchange of Part of a Reserve for Other Land

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Otago Regional Conservator, Department of Conservation hereby authorises the exchange of that part of the reserve described in the First Schedule hereto, for the land, described in the Second Schedule hereto.

First Schedule

Otago Land District—Dunedin City

3.1790 hectares, more or less, being Section 161, situated in Green Island Bush Survey District, S.O. Plan 22127, part Gazette notice 561048.

Second Schedule

845 square metres, more or less, being Lot 1, D.P. 20152, situated in Green Island Bush Survey District, all certificate of title 11B/621.
