Second Schedule

Conditions

(i) Damage to the property or to growing crops done by the Crown its agents or workmen during the immediate or any future entry for laying, inspecting, maintaining, repairing or renewing the said cable or cables or erecting and maintaining any fixtures shall be made good at the expense of the Crown and the property restored as reasonably practicable to the condition existing before entry or alternatively the Crown may at its option compensate the registered proprietor for any such damage or loss of crops.

(ii) The cable or cables shall be buried at a minimum depth of 1.2 metres below the surface of the land.

(iii) The registered proprietor shall not erect or permit to be erected any building structure or structures or plant or permit to be planted any trees on the land covered by the easement.

(iv) The surface soil of the easement may be worked to a depth of 80 cm, but in the event of the registered proprietor desiring to work the soil at a greater depth than 80 cm it shall, before commencing any such work, notify the Crown of its intention to perform such work.

(v) The Minister may at any time surrender the easement by Notice in the Gazette pursuant to section 42 (4) (a) of the Public Works Act 1981 or memorandum of transfer in terms of the Land Transfer Act 1952.

A Right to Convey Water Acquired for Irrigation Purposes near Kerikeri, Northland

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Lands, Auckland declares that an agreement to that effect having been entered into, a right to convey water containing the rights and powers set forth in clauses 1, 2 and 5 of the Seventh Schedule to the Land Transfer Act 1952, as modified by the agreement dated the 8th day of April 1983 between the Crown and Brian John Plowman, company director and John Wesley Coombes, insurance agent both of Auckland, a copy of which may be perused at the office of the Department of Lands at Auckland and identified by No. 50/12/52/0/138 is hereby acquired over the land described in the Schedule hereto, for irrigation purposes and shall vest in the Crown on the date of publication in the Gazette.

All that piece of land containing 1220 square metres, being part Lot 2, D.P. 62724; as shown marked “C” on S.O. Plan 56526, lodged in the office of the Chief Surveyor at Auckland.

Land at Broadfields Acquired for Education Purposes

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Lands, Christchurch, declares that an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for education purposes and shall vest in the Crown on the date of publication of this declaration in the Gazette.

Canterbury Land District—Selwyn District

827 square metres, being Lot 2, D.P. 24194; balance certificate of title No. 5B/1370, limited as to parcels and title.
