Advertisement of Application for Winding Up of Company by the Court

In the matter of the Companies Act 1955, between Brother Distributors Limited, a duly incorporated company having its registered office at Christchurch and carrying on business as a wholesaler and importer.—Plaintiff:

And—Delta Business Systems Limited, a duly incorporated company having its registered office at Sixth Floor, 64 Dixon Street, Wellington and carrying on business as a business system dealer.—Defendant:

Take notice that on 10 January 1989, an application for the winding up of Delta Business Systems Limited by the High Court was filed in the High Court at Wellington.

The application is to be heard before the High Court at Wellington on 12 April 1989 at 10 a.m.

Any person, other than the defendant company, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before that day.

The applicant is Brother Distributors Limited, whose address for service is care of Messrs Kevin Smith & Nigel Hughes, Sixth Floor, Challenge House, 85 The Terrace, Wellington.

In the matter of the Companies Act 1955, and in the matter of Lanwood Industries Limited, of 622 Tremeaine Avenue, Palmerston, manufacturers—Plaintiff:

And—Stouffers Promotions Limited, a duly incorporated company having its registered office at 131 Beach Road, Auckland and carrying on business there and elsewhere as promoters—Defendant:

Notice is hereby given that a statement of claim to wind up Stouffers Promotions Limited; was on the 22nd day of February 1989, presented to the High Court of New Zealand, Auckland Registry by Lanwood Industries Limited; and that the said statement of claim is directed to be heard before the Court sitting at Auckland on the 3rd day of May 1989 at 10 o’clock in the forenoon and any creditor or contributory of the said company desirous to support or oppose the making of an order on the said statement of claim may appear at the time of hearing in person or by his counsel for that purpose; and a copy of the statement of claim will be furnished by the undersigned to any creditor or contributory of the said company requiring a copy on payment of the regulated charge for the same.

This notice is placed by solicitors for the plaintiff, Jacobs Florentine & Partners, Ninth Floor, National Mutual Centre, corner The Square and Fitzherbert Avenue, Palmerston North. Their address for service is at the offices of Messrs Bell Gully Buddle Weir, Solicitors, Fourth Floor DFC House, corner Queen and Rutland Streets, Auckland (J. A. Duthie, Solicitor).

Note: Any person who intends to appear on the hearing of the said statement of claim must serve on or send by post to the above-named, notice in writing of his intention to do so. The notice must state the name, address and description of the person or if it is a firm, the name and address and description of the firm and an address for service within 5 kilometres of the office of the High Court of New Zealand, Auckland Registry, and must be signed by the person or firm or his or their solicitor, if any, and must be served, if sent by post in sufficient time to reach the abovenamed address for service not later than 4 p.m. on the 2nd day of May 1989.
