Notice of Decision of Disciplinary Committee of the New Zealand Society of Accountants

Notice is hereby given by the Disciplinary Committee of the New Zealand Society of Accountants that at a hearing held on 14 November 1988, Desmond Thomas Morris, chartered accountant of Pukekohe, appeared before the committee on charges that he had been guilty of defaults discreditable to an accountant, and that he had been guilty of unprofessional conduct.

The charges arose from the member arranging for a client to make an advance in circumstances when he represented that he would personally guarantee the said advance and/or in circumstances when he uplifted the said advance for his client: without ensuring the client obtained independent advice; without ensuring that the advice was properly secured; when he had a personal interest in the advance being made; without properly disclosing to the client the full details of the proposed advance and/or his personal involvement and/or adequate security; and failing to ensure that the said advance which he personally uplifted from his client was deposited into a trust account in the name of his said client. In respect to the said advance the member: failed within a reasonable and proper time execution of adequate and registrable security for the said advance; failed to provide within a reasonable and proper time a valid registered security for the said advance; failed properly to comply with the demand for repayment of the loan; and failed within a reasonable and proper time after undertaking to repay the said advance, to make repayment thereof.

The Disciplinary Committee found all charges proven and censured the member. The Committee imposed a penalty of $200 plus GST pursuant to section 24 (3) (c) of the New Zealand Society of Accountants' Act 1958, and pursuant to section 24 (3) (e) of the same Act, ordered the member to pay the sum of $9,000 plus GST in respect of costs and expenses of and incidental to the inquiry by the Disciplinary Committee and the investigation by the Investigation Committee.

The Disciplinary Committee directed that its decision be published in The Accountants' Journal and the New Zealand Gazette with mention of the member's name and locality.
