The Tribunal’s decision was intended to encompass not only the specific publication Playboy Presents 100 Beautiful Women but that series of special publications published by Playboy Press of the range exemplified by that particular individual publication. I confirm on behalf of the Tribunal that that was its intention in respect of the section 15A order.

Decision

These publications were commercially imported through air freight Auckland on 22 May 1989 and were seized by the Collector of Customs. The importer having subsequently disputed forfeiture and publications were referred to the Tribunal for classification prior to the commencement of condemnation proceedings pursuant to the Customs Act 1966.

All of the publications were produced in the United States of America and published by Parliament Publications. In his submission to the Tribunal on behalf of the Comptroller of Customs Mr Wotherspoon has classified the publications in 2 groups under appendices A and B. In respect of the magazines under appendix A Mr Wotherspoon suggested that although these contain a significant number of photographs which place undue emphasis on the female genitalia with many of the models being posed in what are clearly contrived positions to accentuate that genitalia the Tribunal might consider classifying as indecent in the hands of persons under the age of 18 years.\n
Mr Wotherspoon referred to earlier Tribunal decisions
