The application is to be heard before the High Court at Auckland on Wednesday, the 13th day of December 1989 at 10 a.m.

And—Christchurch Electroplating Company Limited, a company duly incorporated at Christchurch under the Companies Act 1933, whose registered office is situated at 4 Oxford Terrace, Christchurch—Defendant:

Take notice that on the 2nd day of November 1989, an application for orders under section 209 of the Companies Act 1955, in respect of Christchurch Electroplating Company Limited was filed in the High Court at Christchurch.

The orders sought are as follows:

To wind up Christchurch Electroplating Company Limited under section 209 of the Companies Act 1955.

An order for the purchase by the members of Christchurch Electroplating Company Limited other than the plaintiff, of the plaintiff’s shares in Christchurch Electroplating Company Limited at a fair price to be determined by the High Court.

An order for the purchase by Christchurch Electroplating Company Limited of the plaintiff’s shares at a fair price to be fixed by the High Court and a reduction accordingly of the capital of the defendant company.

Such other order under section 209 (2) of the Companies Act 1955, as is necessary to remedy the matters of which the plaintiff complains in the statement of claim.

The application is to be heard before the High Court at Christchurch on Monday, the 4th day of December 1989 at 10 a.m.

The statement of claim and the verifying affidavit may be inspected at the office of the High Court at Christchurch or at the plaintiff’s address for service.

Any person, other than the defendant company, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before that above-mentioned day of hearing.

The plaintiff in the proceeding is Desmond John Alexander Mitchell, whose address for service is at the offices of his solicitors, Messrs Anthony Harper, 115 Kilmore Street, Christchurch (P.O. Box 2646, DX 16231, Christchurch).
