Notice of Decision of Disciplinary Committee of the New Zealand Society of Accountants
Notice is hereby given by the disciplinary committee of the New Zealand Society of Accountants that at a hearing held on 17 August 1989, Michael John Wayman of Auckland, appeared before the committee on charges that: he had been guilty of defaults discreditable to an accountant, he had conducted himself in such a manner as to render the exercise of the powers of the disciplinary committee expedient in the interest of the public and of the society, and that he had been guilty of unprofessional conduct.
The charges arose from the member:
being a member of the New Zealand Society of Accountants and being a holder of a Certificate of Public Practice and without the consent of the council, being and/or having been a director and/or shareholder in a company called Michael Wayman and Associates Ltd. which carried on and/or was empowered to carry on the business of accounting, carrying on practice other than in his own name, and having permitted a corporation which was not a member of the society to practice in his name as a chartered accountant, and
on or about 16 April 1987 having been convicted in the Auckland District Court; wilfully misleading the Commissioner of Inland Revenue in respect of a client’s return of income, and wilfully giving false information in relation of the income of a client.
The member pleaded not guilty to all charges.
The disciplinary committee found all charges proven.
The name of Michael John Wayman was removed from the Register of the New Zealand Society of Accountants pursuant to section 24 (3) (a) of the New Zealand Society of Accountants Act 1958 and pursuant to section 24 (8) of the same Act, the disciplinary committee set the date of 31 August 1994 as the earliest date on which Michael John Wayman might apply for re-registration. Pursuant to section 24 (3) (e) of the same Act, the disciplinary committee ordered the member to pay the sum of $3,500.00 plus GST in respect of costs and expenses of and incidental to the inquiry by the disciplinary committee and the investigation by the investigation committee.
