Land Acquired for a Limited Access Road in Whangarei County

Pursuant to sections 20 and 153 (2) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Manager, Department of Lands Auckland, declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired subject to the land firstly described in the Schedule hereto to the easement in respect of mining rights contained in conveyance No. 287506 (R330.335), North Auckland Land Registry, for a limited access road, which has become road, limited access road and State highway and, pursuant to section 11 (1A) of the National Roads Act 1953 shall form part of State Highway No. 1.

Amending a Notice Declaring Land to be Crown Land in Onehunga Borough

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Manager, Department of Lands, Auckland hereby amends the notice dated the 3rd day of December 1987 published in the New Zealand Gazette of the 10th day of December 1987, No. 221, page 5679, declaring land to be Crown land pursuant to section 42 of the Public Works Act 1981, by inserting in the operative clause after the words “Land Act 1948” the words “and to the pipeline easement in gross created by transfer B. 845503.1, North Auckland Land Registry”.

Declaring a Cable Easement over Land for an Automatic Marine Beacon to be Acquired and Portion of Easement Surrendered in Whangarei County

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Manager, Department of Lands, Auckland:

(a) Pursuant to section 20 declares that, agreements to that effect having been entered into, an electric cable easement is hereby taken for an automatic marine beacon vesting in the Crown on the 5th day of October 1989 the full and free right, liberty, licence and authority in perpetuity for the Crown’s servants, agents and employees to lay, construct, place, reconstruct, repair and maintain an electric cable along, under, or over the land described in the First Schedule hereto, together with the full and free right, liberty, licence and authority for the Crown’s servants, agents and employees from time to time and at all times to go, pass, repass, with or without vehicles or other equipment for the said purposes, such easement to be held appurtenant to the land described in the Second Schedule hereto; and

(b) Pursuant to section 42 (4) (a) surrenders the electric cable easement created by the declaration dated 21 February 1966 and published in the New Zealand Gazette of 10 March 1966, No. 13 at page 349, registered as A138925, North Auckland Land Registry.
