Declaration That Land Is A Reserve

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Acting Regional Conservator hereby notifies that the following resolution was passed by the Wellington City Council on the 5th day of October 1986.

"That in exercise of the powers conferred on it by section 14 of the Reserves Act 1977, the Wellington City Council hereby rescinds that the piece of land held by the said city in fee simple, and described in the Schedule hereto, shall be, and the same is hereby, declared to be a recreation reserve within the meaning of the said Act."

Classification and Naming of Reserve

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Manager, Department of Conservation, hereby classifies the reserve described in the Schedule hereto, as a historic reserve, and further, declares that the said reserve shall hereafter be known as the Reefton School of Mines Historic Reserve subject to the provisions of the said Act.

Revocation of the Reservation Over a Reserve Specifying the Manner of Disposal and How Proceeds of Sale Shall be Utilised

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation the Director of Estate Protection Policy hereby revokes the reservation as a recreation reserve over the land, described in the Schedule hereto, and further, declares that the said land may be disposed of by Waimairi District Council at current market value, the proceeds from any such sale to be paid into the council’s reserves account, such moneys to be used and applied in or towards the improvement of other reserves under the control of the council, or in or towards the purchase of other land for reserves.

Mining Act 1971

Exemption of Land from Mining

Pursuant to section 24 (1) (a) of the Mining Act 1971 the Minister of Energy hereby gives the following notice:

Notice

The land described in the Schedule hereto is hereby exempted from section 69 of the Mining Act 1971 in respect of the grant of mining licences which would permit mining operations to be carried out by or as part of a large-scale opencast mining operation.

In this notice, the term "large-scale opencast mining operation" means any opencast mining operation that involves or will involve the removal or excavation of more than a total of 100 000 tonnes in any 1 year of overburden, rock, ore, mineral deposit, or other material.

Plans of the area to which this notice relates are held by the Chief Surveyor, Hamilton; the Inspector of Mines, Hamilton; and the Secretary of Energy, Wellington.

This notice shall come into force on the date of its publication in the Gazette and shall remain in force for a period of 15 months from that date and shall then expire.
