Marine Mammals Protection Act 1978
Notice of Intention to Amend the Marine Mammals Protection (Banks Peninsula Sanctuary) Notice 1988
I hereby give notice of my intention to amend the Marine Mammals Protection (Banks Peninsula Sanctuary) Notice 1988 so as to—
(a) Define a “flounder area” within the sanctuary to which that notice relates; and
(b) Allow set nets for flounder to be used at any time of the day or night (between 1 March and 31 October) within the flounder area; and
(c) Allow set nets up to 60 metres long to be used for flounder within the flounder area; and
(d) Allow set nets for flounder to be set and left unattended within the flounder area; and
(e) Substitute, for the requirement that a set net that is set in the sanctuary from a boat should remain attached to the boat, a requirement that a boat from which a set net is set in the sanctuary must remain crewed, and in sight of and not more than 50 metres from the net, while the net remains set.
The flounder area will comprise the areas of the sea that are on the landward side of the following lines:
(a) A line in Akaroa Harbour between grid 059103 (Green Point) and grid 038118 (Ohae) on map N36 (NZMS 260):
(b) A line in Port Levy between grid 968289 (jetty) and 955289 (wharf) on that map:
(c) A line in Pigeon Bay between grid 024268 (Teopopaka Point) and grid 013268 on that map:
(d) A line in Lyttelton Harbour between grid 867302 (Hays Bay) and grid 831325 on map M36 (NZMS 260).
Section 22 (1) of the Marine Mammals Protection Act 1978 requires me to consider, before varying, redefining, or abolishing a sanctuary declared under that section, any submissions in writing I may have received within 28 days after the publication of a notice in the Gazette indicating my intention to do so.
Submissions may be sent to The Minister of Conservation, care of Director, Protected Species Policy, Department of Conservation, P.O. Box 10-420, Wellington.
