Advertisement of Application for Winding Up of a Company by the Court
Take notice that on the 19th day of July 1989, an application for the winding up of Hams Barton Limited by the High Court was filed in the High Court at Hamilton.
The application is to be heard before the High Court at Auckland on the 30th day of August 1989 at 10 a.m.
Any person, other than the defendant company, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before that day.
The applicant is Messrs C. Kennedy & Co., and John Russell Galvin and Paul Ivan Tolich, trading as Epsom Construction. The address for service of the above-named applicants is at the offices of C. Kennedy & Co., Solicitors, Sixth Floor, ANZ House, corner of Queen and Victoria Streets, Auckland 1.

Notice is hereby given that by a duly signed entry in the minute book of the above-named company, on the 11th day of August 1989, the following extraordinary resolution was passed by the company, namely:
That the company cannot by reason of its liabilities continue its business and that it is advisable to wind up, and that accordingly the company be wound up voluntarily.

Pursuant to Section 269 of the Companies Act 1955
Notice is hereby given that by means of an entry in the minute book of C & M Lewis Ltd., in accordance with section 362 (2) of the Companies Act 1955, the following special resolution was passed on 2 August 1989:
...That the company, having filed a declaration of solvency in compliance with section 274 (2) of the Companies Act 1955, be wound up voluntarily and that Messrs A. E. Chester and S. C. Grey, chartered accountants of Auckland, be appointed liquidators...
The liquidators hereby fix the 31st day of August 1989, as the day on or before which the creditors of the company are to prove their debts or claims, and to establish any title they may have to priority under section 308 of the Companies Act 1955, or to be excluded from the benefit of any distribution made before the debts are proved, or as the case may be, from objecting to the distribution.
