Declaring Easement Over Land Acquired for Soil Conservation and River Control in the County of Hawke's Bay

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Lands, Napier, declares that, an agreement to that effect having been entered into, the following easement in gross is acquired for soil conservation and river control purposes (and may be surrendered at any time by notice in the Gazette) vesting in The Hawke's Bay Catchment Board (called the grantee) on the date of publication of this notice in the Gazette, the right to drain stormwater and surface water including the full and free right in perpetuity for the grantee and its agents to do the following over the land described in the Schedule together with licences:

(a) to dig and construct a drain or lay a piped drain through the land;

(b) to inspect, repair, cleanse, dig up, alter, enlarge, renew or replace the drain or any pipes;

(c) for the purposes of this grant the board's agents, workmen and employees may, with or without vehicles enter the land and generally do anything necessary or convenient for the full exercise of the rights so granted.

Subject to the Board:

(a) indemnifying the owners from all actions, proceedings and claims arising out of or in connection with the drain;

(b) maintaining the drain so that at all reasonable times there is no subsidence and a free and unimpeded flow of water.
