Land Acquired for Road, Land Declared to be Road, Road Stopped and Land Taken in the County of Wanganui

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Lands, Wellington.

(a) Pursuant to section 20 (1), declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for road and vested in The Wanganui County Council on the date of publication hereof in the Gazette.

(b) Pursuant to section 114, declares the land described in the Second Schedule hereto to be road and vested in The Wanganui County Council.

(c) Pursuant to sections 116 (1), 117 and 120 (3), declares the portion of road described in the Third Schedule hereto to be stopped and amalgamated with the land in certificate of title No. 28D/858, subject to memorandum of mortgage 9800111.1.

(d) Declares the land described in the Fourth Schedule hereto to be taken under section 119 (1) and to be amalgamated with the land in certificate of title No. 23D/858, subject to memorandum of mortgage 9800111.1.

Wellington Land District—Wanganui County

Land Acquired for Road

All those pieces of land situated in Block XIV, Nukumaru Survey District, described as follows:

As shown marked as above mentioned on S.O. Plan 35216, lodged in the office of the Chief Surveyor at Wellington.

Second Schedule

Wellington Land District—Wanganui County

Land Declared to be Road

All that piece of land containing 1169 square metres, situated in Block XIV, Nukumaru Survey District, being part Lot 1, D.P. 12805: as shown marked “A” on S.O. Plan 35216, lodged in the office of the Chief Surveyor at Wellington.

Third Schedule

Wellington Land District—Wanganui County

Road Stopped and Amalgamated

All that piece of road containing 8576 square metres, situated in Block XIV, Nukumaru Survey District, adjoining or passing through Part Section 42, Waitotara District, Lots 81, 82, 100, 101, 102, 103, 104, 105, 106, 107, 108, 109 and 110, D.P. 169, part Lot 1, D.P. 12805, and part railway; as shown marked “G” on S.O. Plan 35216, lodged in the office of the Chief Surveyor at Wellington.

Fourth Schedule

Wellington Land District—Wanganui County

Land Taken and Amalgamated

All that piece of land containing 1594 square metres, situated in Block XIV, Nukumaru Survey District, being Part Lot 1, D.P. 12805; as shown marked “C” on S.O. Plan 35216, lodged in the office of the Chief Surveyor at Wellington.

Land to be Set Apart for Road (State Highway No. 1) in Blocks IX and XI, Cape Campbell Survey District

Pursuant to section 52 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Solicitor, Department of Lands, Wellington, hereby declares the land described in the Schedule hereto to be set apart for road, which pursuant to section 11 (1A) of the National Roads Act 1953 shall form part of State Highway No. 1 and shall remain vested in the Crown.

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Solicitor, Department of Lands, Wellington, declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for the purposes of a road (State Highway No. 1) and shall vest in the Crown on the 20th day of July 1989.
