this damage or loss will be fully compensated and made good by the licensee on terms and conditions to be agreed with the licensee in advance of the commencement of mining operations, and failing agreement on such reasonable terms as shall be determined by agreement between the licensee and the council or failing agreement by arbitration in accordance with the provisions of the Arbitration Act 1908.

  1. In like manner and prior to commencement of mining, compensation for the loss of any land or for the loss of income relating to the loss of use of any land shall be agreed with the licensee.

  2. The licensee will be required to reimburse the council for expenses incurred in obtaining advice on matters relating to this application. In particular advice received from experts on legal, mining, valuation and soil restoration matters.

  3. In the event of a mining operation proceeding, both parties knowledge that the council expressly reserves the right to negotiate with the licensee on all questions that will arise if the applicant decided to apply for a mining licence, including questions of profit sharing or other forms of remuneration to council and/or conditions relating to any mining operation.

  4. The licensee will prepare a prospecting plan for the council’s approval prior to commencing physical prospecting operations on the land.

All that area of endowment land being part Section 17, Block I, part C.T. 121/184 bounded by Lot D.P. 18203 to the East, Cemetery Road and State Highway No. 6 to the north, Sandflat Road to the west and unnamed road to the south, in Block 1, Cromwell Survey District, all the land being in the Vincent County and Otago Land District.
