Maori Land Development Notice

Pursuant to section 332 of the Maori Affairs Act 1953, the Board of Maori Affairs hereby gives notice as follows:

Notice

  1. This notice may be cited as Maori Land Development Notice Rotorua 1989, No. 3.

  2. The notice referred to in the First Schedule hereto is hereby amended by omitting all reference to the land described in the Second Schedule.

  3. The land described in the Second Schedule hereto is hereby released from Part XXIV of the Maori Affairs Act 1953.

New Zealand Railways Corporation Act 1981

Declaring a Right of Way Easement in Gross at Lyttelton to be Acquired for Railway Purposes

Pursuant to sections 24 and 30 of the New Zealand Railways Corporation Act 1981 and section 20 of the Public Works Act 1981, the Chief Executive of the New Zealand Railways Corporation hereby declares that, an agreement to that effect having been entered into, a right of way easement in gross described in the First Schedule hereto, over the land described in the Second Schedule hereto is hereby acquired for and on behalf of Her Majesty the Queen for railway purposes.

First Schedule

Right of Way Easement in Gross

The rights and powers implied in and attaching to a right of way subject to section 90D of the Land Transfer Act 1952 and incorporating the provisions of the Ninth Schedule of the Property Law Act 1952, provided however firstly that what is a “reasonable contribution” in any case within the meaning of paragraph 2 (c) of the Ninth Schedule shall be determined having regard to the degree of user of the driveway enjoyed by the particular party from whom such contribution is sought and secondly that if any dispute shall arise in relation to the right of way easement in gross the subject of this notice, it shall be referred to arbitration under the provisions of the Arbitration Act 1908 and its amendments, or such other legislation as may be enacted in its place.

Second Schedule

Canterbury Land District—Lyttelton Borough

Land Subject to a Right of Way Easement in Gross

All that piece of land situated in Block IV, Halswell Survey District, being part Lot 1, as shown marked “A” on D.P. 53244. Part certificate of title 31B/1190, Canterbury Registry.

Dated at Wellington this 4th day of July 1989.
